SW0801-CS090709 (2)(9/2812009) DiWanna Baskins - RE: Denton Tap Sidewalk Project From: DiWanna Baskins To: Greg Yancey Date: 7/9/2009 8:02 AM Subject: RE. Denton Tap Sidewalk Project Hello Greg, 1. Yes, the City will maintain the sidewalk that we have built. So, that is the entire sidewalk fronting 580 Denton Tap Road. 2. To make sure I am clear, the property does not become the City's property. We are being granted permission to build the sidewalk and maintain on the First Baptist Church's property. It's different from acquiring Right-of -Way, in which the property changes owners and becomes the City's property. Perpetually is a strong adverb. Replats and redevelopments do occur. If the developers/owners wanted to revamp the entire property in the future, they would be able to discuss their ideas/options with the planning and engineering departments. Owners, for instance, may want a more scenic/curving sidewalk. Or owners may expand and acquire adjacent lots throughout and want to revamp a much larger development. In short, is as long as the sidewalk remains, the City will be responsible for maintaining it. Have I answered your questions for complete understanding? Sincerely, DiWanna »> "Greg Yancey" <gregyanceyClverizon.net> 7/9/2009 7:26 AM »> Our questions are: 1. Is the City agreeing to maintain the entire walk? 2. Does the walk remain City property perpetually? Thanks, Gregory K. Denton Tap Sidewalk Project Hello again Greg! I have attached the easement documents prepared by the surveyor. You will notice that we did move the sidewalk back a bit. The landscaped vegetation you recently put in will not be affected. The boulders' placement may need to be adjusted. Thanks again for working with me on this sidewalk project. If you have any questions or concerns, absolutely let me know. Is it ok to have the surveyor prepare 2 feet just in case we shift the sidewalk further from the street? I would like to have the sidewalk at least one foot off the back of curb, if possible. This will not affect any of your landscaping.
