Dear Mr. Redden:
Upon review of the Plan and Profile sheets of the above-referenced project sent with
H.D.R. Engineering, Inc.'s June 12, 1995 transmittal letter, permission to cross Explorer's
existing 12 3/4 inch high-pressure petroleum products pipeline with the proposed 15-inch sanitary
sewer line encased in 20-inch steel pipe is hereby granted, only in so far as Explorer has the right,
title and interest to grant such permission, subject to the following terms and conditions:
City of Coppell (hereinafter referred to as "CITY") or its designated representative shall
give Explorer's area office written notice at least 48 hours in advance of any construction
contemplated near the pipeline in order that a field representative of Explorer be present.

CITY shall also include the following warning on all construction plans that involve
Explorer's pipeline:

CITY hereby agrees to assume the risk of~ and shall protect, indemnify, and save harmless
Explorer from and against all liability for or on account of~ injury to or death of persons or
damage to property, resulting from CITY'S operations, including the installation of the
20-inch cased 15-inch sewer line by or for CITY except where such injury, death or
damage shall be caused by the negligence of Explorer, its agents, servants, or employees.
CITY shall not permit eqUipinent to work over or within 15 feet of Explorer's 12 3/4-inch
pipeline without prior approval of Explorer's field representative.
In consideration of the work CFFY will perform over and under the pipeline, and the
promise to defend and indemnify Explorer as provided herein, Explorer will permit the
sanitary sewer line to be constructed under its pipeline as shown on Plan and Profile Dwg.
No. 5.
With an Explorer Pipeline Representative present, the pipeline shall be exposed during
proposed bored crossing under railroad to insure that bore bit does not strike pipeline.
Upon casing installation the backfill between Explorer's 12 3/4-inch pipeline and CTI'Y'S
20-inch casing is to be compacted to A.S.T.M. Standard 95% Proctor, tested, and a copy
of the results sent to my attention in Explorer Pipeline's Tulsa Ot~ice.
The proposed sewer line shall be well-marked with signs identifying owner, type of
service, and emergency phone number(s).
Any future proposed below-ground utilities to cross above or below the pipeline or any
furore, proposed above ground utilities to be installed will require a separate agreement.
This permission may not be assigned by you without the prior written consent of Explorer
Pipeline Company.
