Hi Greg,
In the first paragraph of the easement document, the language covers future maintenance of the sidewalk by the city.
"GRANTEE herein, its agents, employees, workmen and representatives having ingress, egress, and regress in, along, upon
and across said premises (the "Easement") for the purpose of making additions to, improvements on and repairs
to said sidewalk or any part thereof."
The bold portion touches on future repairs (maintenance) of the sidewalk in the future, which is granted by the Grantor.
As far as drawing that the contractor would receive, usually they are black and white and do not include an aerial. We
included the aerial to provide more information on the surrounding site. The note that will be included is the distance from
the back of curb. However, the surveyor prepared easement documents shows that information, although it is not always
easy to decipher.
Also, I will include these a-mails in the file on record and certainly attach with the a copy of the documents you will have.

That isn't what I'm saying. There is no redevelopment issue of any kind.
The church can't look at it and understand where it is or what it looks
like. They also can't read it and see anywhere that the City maintains it.
Perhaps you could highlight that language and return it?
They don't want to send it to an attorney before signing. Do you have a
drawing like a contractor would receive to build it?
Any ideas?

As far as setbacks and other Planning Department requirements if
redevelopment were to occur, the sidewalk does not increase Planning Dept's
requirements.

Yes, it's just not possible to look at the survey and determine how it
affects the property.

Hello Greg,
1. Yes, the City will maintain the sidewalk that we have built. So, that
is the entire sidewalk fronting 580 Denton Tap Road.
2. To make sure I am clear, the property does not become the City's
property. We are being granted permission to build the sidewalk and
maintain on the First Baptist Church's property. It's different from
acquiring Right-of -Way, in which the property or a portion of the property
changes owners and becomes the City's property.
Perpetually is a strong adverb. Replats and redevelopments do occur. If
the developers/owners wanted to revamp the entire property in the future,
they would be able to discuss their ideas/options with the planning and
engineering departments. Owners, for instance, may want a more
scenic/curving sidewalk. Or owners may expand and acquire adjacent lots
throughout and want to revamp a much larger development.
In short, as long as the sidewalk remains, the City will be responsible for
maintaining it.
