The area itself is not currently in a designated floodplain based on undeveloped conditions as shown on our most recent floodplain maps. However, it is shown to be future floodplain in our ultimate Storm Water Management Study. Our Floodplain Ordinance refers to "floodplain management areas" as being the area that we regulate. Floodplain management areas do not need to be in a designated floodplain. Also, the valley storage requirement is based on the design base flood. This would be the flood from the fully developed watershed. As previously stated, with a fully developed watershed, this creek will be in the floodplain. Therefore, we will be requiring that valley storage requirements be met. I have some concern whether you can even reclaim any of the area. We are trying to improve the creek (ditch) between Loch Lane and Coppell Road in the old part of town and have been stopped in our tracks by the federal government. (This ditch is also not shown in a designated floodplain.) The area has been declared "waters of the US" and we are not allowed to improve it. We are trying to design some type of earthen 'ditch' that mets their requirements. Obviously, with the earthen approach we need more land because of slower velocities. We are also being required to deed restrict the drainage easement to ensure nothing ever happens in the area that would disturb the ecosystem. But, enough of my problems. I am just sharing this to say that I might not have the final decision on what you propose. In summary, we will require that valley storage be met and that you adhere to all requirements fora 404 permit.
