Greg,
Here is what I've found out:
1. The 10' construction easement is shown on the plans for the Denton
Tap construction that took place in the late 1980's through Early
1990's. The city never filed those easements at the courthouse, and
when the construction was completed, the easements were effectively
abandoned. The "City of Coppell Map 1005A-47 and 1005A-48 are simply
the plan and profile sheets for this construction. They are not legal
documents as far as ownership is concerned.
From my records, I don't see that we acquired any additional ROW on the
property to the north when they came through. You will be required to
construct sidewalk an landscaping along Denton Tap when that portion of
the property develops. That may require the dedication of sidewalk
and/or utility easements, however no additional ROW will be required.
Resolution Number 031296.1 is not related to these easements. This
document is actually related to question number 3, and I'll get to in a
minute.
2. This is probably related to a sewer line that runs due north,
crosses Bethel School Road, then turns west on the north side of the
road. There was a 40' temporary construction easement in this
vicinity, but is should no longer be in place. I would have to look at
the survey to see exactly what it is.
3. The previous resolution actually vacated the assessment for Mr.
Thweat's property in exchange for him granting the easements to
construct the sewer line referenced in question number 2. You will
however be assessed roadway impact fees in accordance with our impact
fee ordinance.

Here are the issues raised with the survey we're using for closing on
this
property:
1. Although not appearing in the deed, the survey shows a note
along
all of Denton Tap
"10' Construction Easement as shown on City of Coppell Map 1005A-047 &
1005A-048. May be in connection with Coppell Resolution No. 031296.1"
I need to determine what this is, especially since the surveyor thought
the
City claimed this 10' when Wynnepage was re-platted to the north of
the
subject property. Can you resolve what this is? Perhaps it's only your
easement from the Denton Tap improvements and would go away when we
re-plat
anyway? If you want to formally file the easement, will we be paid?
2. Along Bethel School Road, an odd R.O.W. easement shows up. It
starts
about 300' from Denton Tap and runs west to the creek. Do you think
this
goes away at re-plat?
3. Finally, will we be assessed the Denton Tap improvements when
we
re-plat? (I'm betting Mr. Thweatt didn't pay one dime!)
