of Texas, described in EXHIBIT "A" attached hereto and made for a more particular description of
said property, upon the following terms and conditions, to-wit:
The consideration to be paid to Seller by Purchaser is as follows
0.854 acm of Exclusive Water Main Easematt at 25% of fee simple

0.687 acm of Temporary Construction Easement at !0% rental for two

2. Seller will convey good and marketable title.
3. Consideration to be paid upon the proper execution and delivery of the Easement Deed.
4. City or its contractor, where applicable will relocate, recomect, or reconstruct existing
fences. privau utilities, sprinkler systems or other improvemeau affected by the acquisition
of the cuemems or property herein unless otherwise noted within this contract.
5. Upon completion of the project, execs dirt and native rock. if any will remain on the
propcrty and contoured smoothly to allow adequate drainage and to mitigau any subsidence.
The foregoing consideration to be paid to Seller shall be considered full compensation for said
property and for any damages that may be claimed or asserted by virtue of the establishment cad
construction of the improvements which the City of Irving shall canstruR establish or erect.
