Mike,
We are somewhat flexible here. We have in the past allowed a development to dedicate sidewalk/utility easement in lieu of
right of way. This allows the sidewalk and utilities to be in the customary location without impacting building setbacks and
landscape buffers.
I can't tell from this drawing the extent of the encroachment into the landscape buffer. I would suggest that we dedicate
ROW up to the landscape buffer and if more area is needed that we call it Sidewalk/Utility Easement.

We need to prepare exhibits for the lease agreement for the funeral home at
Rolling Oaks. To do so properly, we need to determine if additional ROW is
needed along the north line of Ruby, and if so, how much. We are not yet
totally certain of the location of the existing ROW. We are just now
finalizing our boundary work. But, we think it is as shown on the attached
exhibit. Also shown is our proposal for a dedication. We are just
offsetting the curb by 11.5 ft. This will result in a variable ROW, but it
can't be helped.
What are your thoughts?
And Marcie, note that this will be an encroachment into the proposed 10 ft
landscape strip. I don't know what kind of heartburn this will cause.
