I've received your requested changes and have forwarded them to our attorney. Hopefully, the changes
can be made without going back to Council for approval of a revised agreement. The only requested
change that I have not recommended to our Attorney is the inclusion of "caused by the activities of the
City prior to the date of this agreement" . The city only controls a portion of the upstream drainage
basin. The silt could have been caused by activities of the city, school or home construction in Chaucer
Estates.
I'll let you know if the changes can be made as soon as I know.

Ken,
I received the Chaucer Estates Pond Agreement in the mail this past weekend. I asked Dan Aaron from the
Chaucer Board to review. He has sent a marked copy of the agreement back to me. Please see attached. It is
mainly clean-up and a few phrase inserts. Will you review and make the appropriate changes? I'll be happy to
stop by the City today or tomorrow to review and sign the agreement.

Did everyone see the blurb about the pond in the Citizen's Advocate on Friday? It was on the front page as the
headliner to the City council meeting. The article talked about the City agreeing to $75k to dredge the pond, but I
didn't think it clearly stated what was going on. I'll write something up to send to the neighborhood later this week.
I'll have you all review it before it is sent.

I received the agreement from the City for the payment of the $75k. The agreement does state the City will
provide inspection services at the time we decide to dredge the pond. Can I fax the agreement to you for review
before I sign it??
Also, I'll be happy to fax the agreement to the rest of you if you want to review. Just send me your fax #.
