Identified on the report are areas of nonconformance with accessibility standards adopted by the Texas Department of Licensing and Regulation for purposes of ensuring compliance with Texas Government Code, Chapter 469. Although deficiencies may have been noted, the referenced project may be eligible for inspection approval if constructed in accordance with the Texas Accessibility Standards. Items which are the responsibility of the owner should be referred to the appropriate person for action. The building or facility owner must request an inspection from the Department (or a Department authorized provider of inspection services) no later then thirty (30) days after the completion of construction. No response is required to this review, however, all items noted as "Unacceptable" should be addressed prior to inspection. **APPLICATION: The application of the Texas Accessibility Standards (TAS) and scope of this review is limited to those pedestrian elements constructed, renovated, modified, or altered within the scope of this project. These pedestrian elements are subject to compliance with TAS 4.1 through TAS 4.35 except as modified by Texas Department of Licensing and Regulation (TDLR) Administrative Rule 68.102. 68.102(b) Application of TAS shall be limited to those pedestrian elements being constructed, renovated, modified, or altered as part of the project scope. The pedestrian elements shall comply with applicable TAS 4.1 through 4.35 except as modified by 68.102. (1) Sidewalks--At sidewalks constructed within the public right-of--way, handrails are not required; however, if provided they must comply with TAS 4.8.5. Where the adjacent roadway has running slopes of 5% or greater, the pedestrian access route shall not exceed the grade established for the adjacent roadway. EXCEPTION: The running slope of a pedestrian access route is permitted to be steeper than the grade of the adjacent roadway provided that the pedestrian access route complies with TAS 4.8. (2) Curb Ramps--At curb ramps constructed within the public right-of--way, handrails are not required; however, if provided they must comply with TAS 4.8.5. For purposes of this section, non-signalized driveways are not considered to be hazardous vehicular areas. (A) At perpendicular curb ramps constructed within the public right of way, detectable warnings complying with TAS 4.29.2 at a minimum of 24" in depth (in the direction of -1- pedestrian travel) and extending the full width of the curb ramp shall be provided where the pedestrian access route enters a crosswalk or other hazardous vehicular area. (B) At parallel curb ramps constructed within the public right-of--way, detectable warnings complying with TAS 4.29.2 at a minimum of 24" in depth (in the direction of pedestrian travel) and extending the full width of the landing shall be provided where the pedestrian access route enters a crosswalk or other hazardous vehicular area. (C) At diagonal curb ramps constructed within the public right-of--way, detectable warnings complying with TAS 4.29.2 at a minimum of 24" in depth (in the direction of pedestrian travel) and extending the full width of the curb ramp or landing, shall be provided where the pedestrian access route enters a crosswalk or other hazardous vehicular area. Additionally, the department will allow the detectable warning to be curved with the radius of the corner. The detectable warning shall be located so that the edge nearest the curb line is 6" minimum and 10" maximum from the curb line. ® IF PROVIDED **NOTE: If constructed, renovated, modified or altered elements including, but not limited to, mailbox(es), fire hydrants, light/power poles, vegetation, etc. reduces the minimum clear width of the accessible route, then compliance is required with the following: 4.3.3 Width: The minimum clear width of an accessible route shall be 36 in (915 mm) except at doors (see 4.13.5 and 4.13.6). If a person in a wheelchair must make a turn around an obstruction, the minimum clear width of the accessible route shall be as shown in Fig. 7(a) and 7(b). ® GENERAL NOTE In accordance with Rule 68.102, in public right-of--way areas where the adjacent roadway has running slopes of 5% or greater, the pedestrian access route shall not exceed the grade established for the adjacent roadway. This running slope deviation from the requirements of TAS 4.3.7 shall also be applicable to any newly constructed, renovated, modified, or altered exterior circulation path that is improved for use by pedestrians, including, but not limited to, sidewalks, driveways, crosswalks, and curb ramps. The cross slope, however, is subject to compliance with the following: 4.3.7 Slope. Nowhere shall the cross slope of an accessible route exceed 1:50 ®UNACCEPTABLE **NOTE: According to Sheet P-5, a lead sidewalk being removed and is being replaced with two steps. An accessible route does not include steps. Compliance is required with the following: -2- 4.3.8 Changes in Levels. Changes in levels along an accessible route shall comply with 4.5.2. If an accessible route has changes in level greater than 1/2 in (13 mm), then a curb ramp, ramp, elevator, or platform lift (as permitted in 4.1.3 and 4.1.6) shall be provided that complies with 4.7, 4.8, 4.10, or 4.11, respectively. An accessible route does not include stairs, steps, or escalators. See definition of "egress, means of in 3.5. ®UNACCEPTABLE **NOTE: The accessible route shall have an 80" minimum clear head room. This includes shrubbery, trees, signage, and any other overhead obstruction. Insufficient information is provided to verify compliance with the following: 4.4.2 Head Room: Walks, halls, corridors, passageways, aisles, or other circulation spaces shall have 80 in (2030 mm) minimum clear head room (see Fig. 8(a)). If vertical clearance of an area adjoining an accessible route is reduced to less than 80 in (nominal dimension), a barrier to warn blind or visually-impaired persons shall be provided (see Fig.8(cl)). ® IF PROVIDED **NOTE: If newly constructed, renovated, modified, or altered transportation stops will be provided within the scope of this project, compliance is required with the following: 4.1.2(5)(c) If passenger loading zones are provided, then at least one passenger loading zone shall comply with 4.6.6. 4.1.2(7) Elements and spaces of accessible facilities which shall be identified by the International Symbol of Accessibility and which shall comply with 4.30.7 are: (b) Accessible passenger loading zones; 4.6.6 Passenger Loading Zones. Passenger loading zones shall provide an access aisle at least 60 in (1525 mm) wide and 20 ft (240 in)(6100 mm) long adjacent and parallel to the vehicle pull- up space (see Fem. 10). If there are curbs between the access aisle and the vehicle pull-up space, then a curb ramp complying with 4.7 shall be provided. Vehicle standing spaces and access aisles shall be level with surface slopes not exceeding 1:50 (2%) in all directions. **NOTE: Ensure the curb ramps that are constructed, renovated, modified, or altered comply with 4.7. According to Sheet 2185-3 diagonal curb ramps are provided, ensure compliance with 68.102(b) (2) (C). Final assessment to be verified during inspection. 4.7.1 Location. Curb ramps complying with 4.7 shall be provided wherever an accessible route crosses a curb. ® IF PROVIDED **NOTE: If pedestrian push buttons will be provided and complies, in this scope of work, ensure they comply with 4.27. Final assessment to be verified during inspection. 4.27.1 General: Controls and operating mechanisms required to be accessible by 4.1 shall comply with 4.27. -3- ® IF PROVIDED **NOTE: If transportation stops with newly constructed, renovated, modified, or altered fixed seating will be provided within the scope of this project, compliance is required with the following: 3.5.11 Assembly Area - A room or space accommodating a group of individuals for recreational, educational, political, social, or amusement purposes, or for the consumption of food and drink, or awaiting transportation. 4.1.3(19)(a) In places of assembly with fixed seating accessible wheelchair locations shall comply with 4.33.2, 4.33.3, and 4.33.4 and shall be provided consistent with Table 4. 4.33.1 Minimum Number. Assembly and associated areas required to be accessible by 4.1 shall comply with 4.33. ® IF PROVIDED **NOTE: If pedestrian push buttons will be provided and complies, in this scope of work, ensure they comply with 4.27. Final assessment to be verified during inspection. 4.27.1 General: Controls and operating mechanisms required to be accessible by 4.1 shall comply with 4.27. ®IF PROVIDED **NOTE: If a bus stop pad is provided with seating, in this scope of work, then compliance is required with the following: 4.33.1 Minimum Number.
