Box 17300 Fort Worth, Texas 76102-0300 Re: Modification of Tributary G-1 Downstream of Bethel Road West USACE Project No.: 200400181 Dear Mr. Swihart: As required in the approved mitigation plan cited in special condition 1 of the U.S. Army Corps of Engineers (USACE) permit letter dated May 4, 2005, the following information is submitted for your records. This letter constitutes the third annual written compliance report, due October 1, 2007 as stated in the mitigation plan cited in special condition 1 of the above mentioned permit letter. The deed restriction for the stream mitigation area required under condition 2 of the permit letter is still in process. The City of Coppell negotiated with two landowners regarding compensatory land swaps to acquire the area needed for the drainage right-of--way in fee simple so that a deed restriction could be implemented. A final settlement has been reached with one of the landowners and negotiations regarding mineral rights for the swapped tracts are currently being finalized with the second landowner. Upon achievement of final agreement with the second landowner and transfer of the land to City ownership, a draft deed restriction will be submitted to the USACE for review and approval prior to being filed with the County Clerk. Photographs taken to document current condition of the project site are included in Attachment A. As shown in the photographs taken August 23, 2007, the new box culverts have recently been completed at Bethel Road West, but the roadway has not yet been constructed. The gabion side-slope protection and channel modification for the jurisdictional stream channel ;north of Bethel Road West have also not been constructed. Current schedule for ;construction completion of the roadway and 1320 SOUTH UNIVERSITY DRIVE approved channel modifications is November 2007.
