Dear Mr. Bisballe:
Attached to this letter is a Change Order which eliminntes the construction of the 12 inch sewer
line from approximately Station 24+37 to approximately Station 20+09. Thi~ is a distance of
428 feet. As we were investigating the most appropriate way to imtall the sewer line down
Bethel School Road across the existing box culvert, additionnl investi~ttion revealed that the line
was a 12" line, not an 8" line as the consulting engineer has shown on the construction plans.
When that was discovered, I instructed the Utility Department to televise the line to determine
the condition. That line was televised on February 27th, 1996 and it was determined that the
existing line was in adequate condition to be left in place.
The Change Order lists seven bids items which will be affected and the amount by which they
will be affected. I chose not to place any reduction in the contract on the change order until
such time as we have had an opportunity to negotiate per the terms of the contract. As you are
aware, the contract states that if any one bid item is 5 % of the total bid and then that particular
bid item is being adjusted by 20% either up or down, then either party can negotiate on that
particular bid item. In looking at the seven Bid Items, I determined that Bid Itetns//11 (12" SS
[10'-15' deep]); //12 (12" SS [15'-20' deep]); //19 (4' manhole); and #32 (R&R 8" concrete)
were all at least 5 % of the total bid and all had been adjusted by at least 20%. Bid Items 29,
36 & 38 will be adjusted according to the price bid on those items.
It is our goal to expedite this Change Order as soon as possible, therefore, the City stands ready
to meet with you to discuss the actual deduction on those particular bid items per the terms of
the contract.
