I spoke w/John Elias and he is not aware of the tree issue... I know you guys dealt with this issue

Staff is in the process of contacting The Mansions this week regarding the other items
(drainage north of Westminster and trees).
The City continues to work on gas well drilling ordinance revisions. At this time, there is
no active, pending application before the City. I expect the Council may adopt revisions
at the April 14 council meeting. The provisions will most likely increase the distance
requiring a public hearing to 1,000 and strengthen noise mitigation requirements, along
with some clarification of habitable structure vs occupied. The last change will include al
structures whether occupied or not at the time of a permit application.

Clay -
The annual meeting of the Asbury Manor HOA is scheduled for April 30th. I have been
asked to circle back to you on several issues which will be discussed with our homeowners
that evening. If you can, I would like to get an update/resolution on as many of these as
you can help me with before the meeting.
(1) The stone masonry drainage easement south of Westminster Way. We would like to
deed that structure/property back to the city as it is most unusual for such structures to
be owned by a small HOA, such as ours. As stated previously, when the property was
developed and all of us original homeowners bought our homes, the plan for that
structure was much less complicated, would have required much less maintenance, and
bore far less liability risk to our HOA, in the event of a possible failure, than does the
current structure. We need to have that risk removed. City maintenance of the structure is
the minimum position, from our perspective. Liability, ongoing, is the far greater issue.

(2) The drainage easement north of Westminster Way is a mess. This area has become a
collection of pools of standing water, ripe as breeding grounds for insects. Well over a
year ago, we meet with you and city staff to discuss our willingness to pay our pro rata
share of a dredging of this easement. Your staff was going to work this out with The
Mansions, but to date, we have heard nothing more about this. Mosquito breeding season
is nearly upon us, so we need to move forward with this project.
(3) Missing trees on The Mansions section of the drainage easement. You will remember
all the dead/dying/missing trees on The Mansions section of the easement down around
the ponds. This problem has been significantly increased in the last six months by
someone's malicious cutting down of nearly a dozen crepe myrtle trees. The were
chopped down with an axe or hatchet and left lying all around. Most likely children. In any
event, all the Mansions has done was to have someone take a chain saw and cut the
stumps down to ground level. This area is now at least 60% denuded of the trees and
shrubs called for in the development plans. If?our homeowners?have to take care of their
walls along the easement?for them, then they, at the very least, should be required to
maintain mandated vegetation there.
(4) An update on Chesapeake drill plans and the city's new drilling ordinance
If you could help me with information on these, Clay, it would be appreciated. Our group
has recently amended our CC&Rs to allow the Board of Directors some architectural
controls, so we are very interested in the upkeep of our properties and issues that affect
them. Having information on all of the above will help us to keep our homeowners
informed and keep things over here moving in the right direction.
