I just got off the phone with Jim. He feels that we should draft a formal letter to her with our response, and he will sign it.
First and foremost, he said that if at any point she is allowed to build a fence (once it is out of the floodplain), the City will
not be participating. Secondly, the City did not make an offer on her property. After the appraisal was done, the decision
was made to NOT make an offer.
Jim would like for all of us to meet next week to discuss this before a letter is drafted. He wants to review if a notice was
sent to her at the time of Hard Eight's public hearing and if she responded at that time. He wants to know how much Hard
Eight is under parked and why they were allowed to under park (basically see the staff report). He wants to talk about the
floodplain issue, etc. I will send an e-mail tomorrow with some proposed times for the meeting next week once I can get
his schedule. In the meantime, was she looking for a response from the city in the next few days? If so, Jim said to tell
her that he is out of town, and we will be meeting next week to get her a response.
Is everyone okay with that?

Well,
The only question I could answer was the fencing question. It needs to be a wooden picket fence in accordance with specifics
listed in the H District of the Zoning Ordinance.
She had more specific questions and was threatening a lawsuit when I talked to her.
The first question is how the city was going to help her build the fence?
The second question was who gave Murray construction out of Lewisville permission to use her property for constructing the Hard
Eight, and how come the Hard Eight is not being violated for using her land as an unimproved parking area.
She also wanted to know how the city was involved financially with this project.
She reiterated the questions that she had already asked Marcie.
We just conference called with Mindi and she said she'd get with Jim Witt on this and figure out what to do. Hopefully, we can get
one contact person for this?

neighbor, Hard 8.
As you are aware the Hard 8 customers are using her property for parking. She was told that she would be required to put up a
decorative metal fence if she wanted to fence her property which would cost her a significant amount of money. (Greg Jones had a
conversation with her yesterday.. but I think he just referred her to us)
Apparently Hard 8 offered her $20,000 for her property, which she considers an insult (flood plain issues?) - she said they were
pretty rude about it to.
She asked how did the city approved a restaurant with so little parking? and what is the city going to do about solving this issue?
I told her that I would find the correct person(s) to respond to her concerns and someone would get back to her.
