Gary,
was hoping you could give me some guidance or point me in the
direction of who could shed some light on the following issue.
We are talking with a potential tenant for the east end of Point West
VII. They would require somewhere around 600 parking spaces. In order
to satisfy that requirement, we would need to build an additional
parking lot to the east of the building on what is now a separate lot,
PW III. This lot would only need to serve PW VII. We would provide
lighting similar to what we have in PW I (the office building). The
drainage for the area where the lot will be located was designed to
drain to the east over the remaining portion of the PW III Lot. My
questions are as follows:
Are there any permits we will need to obtain to construct this
parking lot and associated lighting?

We would like to start be able to start construction as quickly as
possible, so it may be best for us to do this in several different ways.
Should we create a separate instrument for a parking easement on PW
VIII, get the construction completed and then follow up with a more
permanent solution, some form of replat? If we created a separate
instrument, how would the drainage be handled? Again, the drainage from
the proposed lot will flow east across the rest of PW VIII. I am
assuming that if we replat the parking lot into the property allocated
to PW VII, we would have to create a drainage easement across PW VIII
for the drainage.
From the questions above, I think the procedural part should be fairly
easy. However, I really wanted the City's input on how to treat the
property with respect to easements and replatting. We may need to move
pretty quickly if so we are interested in the route that gets the
parking lot constructed as quickly as possible, but understand some
additional work may be required to provide the final, more appropriate
solution.
