4.2 Progress Payments Based upon Applications for Payment submitted to Duke by the
25th day of the month, Duke shall make progress payments to the Subcontractor within ten (10) days of
Duke's receipt of payment from the owner. Applications for Payment received after the 25th day of the
month shall not be processed until the 25th day of the next month.
4.3 �Retainage Duke shall retain from each progress payment a sum equal to ten percent
(10 %) of the progress payment authorized by Duke for payment to the Subcontractor. Retainage Will not
be released prior to thirty (30) days following final completion of the Work.
4.4 Final „Payment Final Payment, constituting the entire unpaid and earned balance of the
Subcontract Sum, shall be paid to the Subcontractor as provided in the Subcontract General Conditions.

Re: Point west Early Grading Permit Fees
Dear Keith:
Per our discussions, the City of Coppell will waive the payment of the permit fee at this time. In return, Duke
Construction agrees to reduce the overall reimbursement to be received as part of the Developer's Agreement by
the associated 2% permit fee totaling $20,331.64.
