We have received the plans from Jack Evans, you may go ahead and install your erosion control. I will review
the plans in the next day or 2, and Larry Davis, the inspector will call to set up a pre-construction meeting for
sometime next week. Attached is the construction permit application in which inspection fees will need to be
paid.

I had a few questions and was not sure who would be appropriate. In late December, Clay Phillips provided
Duke with a hold harmless option for the construction of a parking lot expansion and its associated utilities
at Point West I. I believe you were both copied on that letter. City Council approved the rezoning and plat
associated with these changes last night. Jack Evans of Pacheco Koch also submitted plans for engineering
review yesterday as well. My question is in regards to construction and the actions Duke needs to perform
to satisfy the City considering we have no official Engineering sign off at this time. If we do begin
construction prior to an official approval, who needs to be notified? There are some public drainage
improvements involved. Would there be any type of 3-way contract we need to put in place? Also, do we
need to get any type of permit for these site improvements?

I really do appreciate the help. We understand that we are running a risk of beginning prior to the Eng.
Dept’s, but time constraints are requiring it. However, we do want to make sure we stay on the correct path
