I responded to a call from Mr. Pletta on April 12, 2006 concerning erosion of his property due to an abandoned city aerial sewer crossing. It appeared as though one of the piers that had supported the crossing had collapsed into the creek and was obstructing some of the water flow. The city within the same time frame sent a crew to remove the old pier. While there he also complained about the neighbors wall, so we took pictures of it as well. I was also in contact with the resident at 154 E. Bethel (the neighbor). They indicated that Mr. Pletta was concerned that the wall they had built as a replacement to their old wood tie retaining wall had been built over the property line. I told them that I had no way to make that determination, and that their best bet would be to have the lot surveyed to make that determination. In reviewing the Laserfiche files from Building Inspections I found a permit application for 154 E. Bethel Road for replacement of the wall and fence. The permit is dated 4/21/09, however it has a survey dated 3/31/06 included in the package. According to that survey the wall appears to encroach a dedicated Floodway Easement by 1.5 feet. Both the survey and the original plat show a the actual floodplain limits to be further from the homes than this Floodway Easement. According to the 2006 survey the wall does not encroach the floodplain itself. I have printed these documents, and have them available to review. Keith Keith Marvin, P.E.
