I assume that as long as this is resolved prior to submitting the Final Plat for review and /or an Ordinance
establishing the Zoning being passed on the property we should be O.K. - it will remain a condition
moving forward to council...

property. I am in agreement
with his analysis of the situation. I hope this sufficiently
answers any questions
regarding the protest from Mr. Berkebile regarding the
discrepancy in question.

Clue to concerns by the landowner lying Wet of the tract of land you
purchased, this letter is to -give you more information regarding the possible
conflict.
The master deed for the Trust ran to the centerl'Ine of Grapevine Creel,
which we followed. It is not. uncommon for more current surreys to discover that
a straight. line from an adjoining tract of land crosses a creek because the
surveyors who. prepared the description along straight survey lines did not
discoVer that they were crossing a creek with their survey, and did not check the
adjoining'' deed to avoid the ' conflict. It is a responsibility of the neighbor that
suggests a conflict to prove his reasons.
If the landowner to the West provides 'Information indicating this conflict by
a certified survey, we will address their concerns at that time. It is our opinion that
the overlapping deeds, which are discovered when later surveys are performed
are not uncommon, and are normally resolved by a boundary line agreement
between the two adjoining landowners.
