Sorry for the delayed reply; I was out of the office yesterday. You are correct that the general rule is that requests for
documents are usually handled through the attorneys once a lawsuit has been filed. In this case, where the City and
Mira Mar necessarily have ongoing dealings because of the development project, the scenario is more complicated,
and it may be appropriate to evaluate such requests on a case-by-case basis. In this case, though, because (1) the
City has already provided the document to Mira Mar’s counsel, and (2) the documents are more relevant to the lawsuit
than the ongoing development; I don’t think the City is obligated to respond to this duplicative request.
I’ll contact Walt Leonard and let him know that Mr. Hawkins wants a copy of the document that he has; and will also
stress that future requests should come through the proper channels.

Mr. Hawkins called my Engineering Tech this morning requesting a copy of my proportionate analysis of the
sidewalk along Denton Tap that is dated 11/12/2007. I'm not sure if we should provide it. It was included in
the information that we provided as a part of their previous petition for information. I'm under the impression
that once a lawsuit has been filed and is ongoing, then all request for information should go through his
attorney. Also, because it was previously provided, his attorney should have the document or have access to
it.
Let me know what we should.
