After discussing the options of having the plat considered on 4/17 or waiting until the LOMR is complete, he requested that the plat as submitted be placed on the 4/17 P&Z agenda, in order to expedite permits for the non-floodplain lots. He also stated that per his client, Rep. Marchant is not pleased at FEMA missing the March 12th date he was originally told was the LOMR issuance deadline. Rep. Marchant is apparently now trying to expedite the LOMR issuance prior to the April 15th, which FEMA now says is the target date. Walt also expects to have Mr. Hawkins' signature on the hold-harmless agreement by the end of the week. The plat indicates the Flood Plain line in the existing (FEMA) location (lots 9-22 in the flood plain). It appears that all drafting have been addressed. The purpose of this submittal is to allow the issuance of a permit for the screening wall along Bethel and Denton Tap. (2/19/2010) Ken Griffin - RE: Alexander Court - Final Plat SubmittalPage 2 I asked Mr. Hawkins if he heard from FEMA.. he said he received bad news today, that even with "congressional action" FEMA said that it will be another 30 days! I also received a call from David Ritter. He had a conversation today with Mr. Leonard, Mr. Hawkins attorney, and said that we should also be receiving a letter waiving the 30 day requirement for plat approval. It appears reasonable not to place this Final Plat on the P&Z Agenda until such time that the Flood Plain line is moved. If this plat is approved and filed as is, then once the flood plain is moved.. a REPLAT would be required.. which is a 60 day process thru P&Z and Council. Again, the sole purpose of this plat submittal is to allow the issuance of a permit for the screening wall along Bethel and Denton Tap. David Ritter said that we should also be receiving a Hold Harmless letter from Mira Mar...in the event that the wall needs to be removed, Mira Mar will be liable and the city will not be..
