Re: Request for additional compensation for Dallas Water Supply Line No.3 project
Mr. Mullins,
As you are aware J.C. Evans Construction Co. has experienced a substantial loss of productivity while trying to
complete the installation of the cased bore at station 114+40 on the above referenced project. We are therefore
requesting compensation for this loss in the amount of $61,703.40 and additional time on the contract in the amount
of 16 calendar days. It is our stance that the situation that caused this delay constitutes a change of conditions to the
project and thereby merits the appropriate adjustment to the contract.
Specifically, the change of conditions referenced above is the location of the 45° bend on the existing 12" waterline.

east to west, towards the excavation for the bore pit, instead of east to west away from the bore excavation provided
the only opportunity for the blow out that occurred in spite of the fact that the excavation was fully 20' away form
the bend. Further exacerbating the potential for a blow out was the fact that the 12" waterline was at an elevation
fully 9' higher than indicated which increased the opportunity for a blow out due to a sloughing effect. Had this
waterline been located as shown on the drawings, thrusting away from the excavation the blow out would never
have occurred.
So that you may be better able to confirm that the requested amount of compensation is due I am providing you with
the timeline and a detailed cost list for equipment, labor and materials on Attachments A, B and C. Should you

TIMELINE
June 18 -- Begin installing 60" pipe in bore.
June 20 -- 12" Waterline blows out filling casing and pipe with mud
June 21 thru 26 -- Remove pipe From bore, clean casing and prep to reinstall. Waterline blows again the evening of
June 26.
June 27 & 28 -- Remove pipe from bore, clean casing and prep to reinstall.
June 29 -- Saturated ground causes thrust block to move on existing 30" CCP and it begins blowing.
June 29 & 30 -- Repair 30" waterline.
July I thru 3 -- Remove pipe, clean casing and prep to re-install.
