Evans Construction Co. 3900 Valley View Lane Irving, Texas 75062 RE: Dallas Water Supply Line - Section 3B Dear Mr. Cervas: As per our recent telephone conversation, I am notifying you of the proposed dispensation of the costs associated with 12-inch Coppell water line breaks occurring June 20 and June 26, 1996. In your correspondence to me dated July 1, 1996, you petitioned the City of Irving for reimbursement in the amount of $61,703.40. The figure was based upon the following: Equipment - 8 days @ $3,060/day $24,480.00 Equipment - 6 days @ $2,700/day $16,200.00 Subtotal $40,80.00 Material $2,210.40 Labor - 163.0 hours @ $25.00 $4,075.00 303.0 hours @ $15.00 $4,545'.00 848.5 hours @ $12.00 $10,182.00 Subtotal $18,802.00 Total Requested Reimbursement $61,703.40 As you recall, we recently had a meeting to discuss this situation. In that meeting, we reviewed your petition. We listened to your perception of the situation. We also reviewed and discussed the perception and diaries of the inspectors present at the job site. And lastly, we discussed with you and the designing engineer the opinion as to responsibility and reason for the situation occurring in the first place. September 12, 1966 Page 3 Since that meeting, as I have explained to you, the City of Irving met with its partners on this project, the cities of Coppell and Lewisville. We have come to a consensus opinion as to our responsibility. That position follows: The diaries and testimonies of all present reveal that J. C. Evans did have equipment and manpower on site for a total of 14 days (8 days @ $3,060.00/day and 6 days @ $2,700.00/day). However, only 2 days @ $3,600.00/day and one-half day @ $2,700.00/day was spent in actual repair of the 12-inch water line. We feel that we are responsible for the cost of those 2 1/2 days, resulting in equipment cost of: 2 days @ $3060/day $6,120.00 1/2 day @ $2,700/day $1,350.00 Subtotal Equipment $7,470.00 We agree with your figure for material costs: $3,120.40 The analysis of the labor costs is analogous to the equipment costs. That is, we agree with unit costs, but we disagree with the mount of units. We feel we are responsible for the labor costs for the two and one-half days referenced. That results in the following: 24 hours @ $25.00/hr. $600.00 48 hours @ $15.00/hr. $720.00 48 hours @ $12.00/hr. $1,152.00 Labor subtotal $2,472.00 Recapping these costs result in the following: Equipment Cost $7,470.00 Material Cost $2,210.00 Labor Cost $2,472.00 Total Cost $12, 152.40 In short, we take the position that rupture of the water lines incurred during the course of construction of this project were not the responsibility of the City of irving. We feel your claim of $61,703.40 is unsubstantiable. The downtime resulting from the water breaks is the responsibility of the contractor. However, in an effort to mitigate your costs and because in repairing the water line break, we feel you performed a service that was Mr. Steven J. Cervas J. C. Evans Constr. Co. September 12, 1966 Page 3 certainly beneficial to Coppell and Irving, we are prepared to offer you the mount of $12,152.40. Please review these figures and take this offer into consideration.
