RE: Grapevine Creek Sanitary Sewer Line (SS 94-02)
Dear Mr. Fikes:
The City of Coppell is currently in the process of obtaining permanent easements for the
construction of a sewer line that will provide improved sewer service for southwest Coppell.
In order to install the sewer line, the City will need a permanent easement-along the southwest
comer of your property adjacent to Denton Tap Road.
In exchange for the 20' x 40' sanitary sewer easement located at the southwest comer of the
Northlake Nursery, the following two conditions have been agreed upon: 1) The City will allow
ingress and egress across the easement which is located on the south end of the property at the
existing driveway; and 2) the City agrees to abandon the sanitary sewer easement behind the
nursery from the railroad tracks north to the point of connection of the service line for the
nursery. This will be done at the time the property is platted.
Your cooperation in working with the City to provide the permanent easement would be greatly
appreciated and will expedite the actual construction of the project.

SANITARY SEWER EASEMENT

KNOW ALL MEN BY THESE PRESENTS
THAT the term Grantor used herein shall be construed in the singular or plural
number as such term respectively represents one or more than one person.
herein as GRANTOR, in consideration of the sum of Ten and no/100 Dollars ($10.00) and other
good and valuable consideration in hand paid by City of Coppeli, Texas, receipt of which is
hereby acknowledged, does by these presents grant, bargain, sell and convey unto City of
Coppeil, Texas, ("GRANTEE"), the free and uninterrupted use, liberty and privilege of passage
in, along, upon and across the following described property owned by Grantor (the "easement
strip") for the purpose of constructing and maintaining an underground sanitary sewer system
across Grantor's main tract with the right and privilege at all times, of the GRANTEE herein,
its agents, employees, workmen and representatives having ingress, egress, and regress in,
along, upon and across said premises (the "easement strip") for the purpose of making additions
to, improvements on and repairs to said sanitary sewer system or any part thereof.
Said easement strip being described in Exhibits "A" and "B" attached hereto and made
a part hereof for all purposes.
That in consideration of the benefits above set out, Grantee will remove from the
easement strip, such fences, buildings and other obstructions as may be found upon said
property. After construction of the underground sanitary sewer system has been completed or
after any entry for repairs or maintenance, GRANTEE shall, except for removed obstructions,
return the surface area of the easement strip to its original condition as nearly as practical taking
into consideration the nature of the work being performed. GRANTORS reserve the right to
use and maintain the surface of the easement strip for purposes which will not interfere with
GRANTEE'S rights hereby granted and agree that upon completion of the underground facility
and restoration of the surface, GRANTEE shall not be obligated for future maintenance and
upkeep of the surface area.
TO HAVE AND TO HOLD unto the City of Coppell, Texas, its successors or assigns
for the purposes aforesaid, the premises above described.

BEING a tract of land situated in the McKINNEY AND WILLIAMS SURVEY, ABSTRACT
NO. 1054, Dallas County, Texas, and being part of a called 4.430 acre tract
of land described in deed to North Lake Nursery & Landscape Co., as recorded
in Volume 86109, Page 0878, Deed Records, Dallas County, Texas, and being
more particularly described as follows:
BEGINNING at a 1/2" diameter iron rod set at the intersection of the East
line of Denton Tap Road-(a 100 foot right-of-way) and the Northwest line of
the St. Louis & Southwestern Railroad (a 100 foot right-of-way);
THENCE North 00 degrees 09 minutes 34 seconds East, 45.34 feet, with the said
East line of Denton Tap Road, to a 1/2" diameter iron rod set;
