Alex,
The attachment is the info received from Mike Daniel last week. We had requested he forward us (unofficially) the
information on easement locations for the gas line extension so we could review potential costs other than
those to be provided by the gasline contractor. The only easement identified is shown on the adjacent property, I
have a call into Mike to get a little more info on where the easement is going to be located within the cemetery
property.
I spoke w/ Mike Garza also last week and he was processing the agreement with the adjacent property owner and
filing for records. He was estimating this was to be concluded last Thursday, but I haven't heard back.
In reviewing the Work Assignment Supplement provided by Atmos I'm not sure Fain Construction can be
considered or execute the agreement as the "Developer". Ron Hayes w/ Atmos had stated he has worked under
previous agreements where the general contractor (not the property owner) executes the Work Assignment
Supplement as the "Developer" in order to expedite the process.
You were going to have the Partners look this agreement over and get back to me. We need to have these
executed and get the process started.

Could you send over a copy of the drawing with the natural gas line extension easement location filed for
recording. We need this in order to have Fain provide any additional costs that might be associated with the work
not provided by the utility contractor, such as required surveys/staking, necessary SWPP, etc.

Yes; that is sufficient. I need the legal name of the developer and the person’s
name that is going to sign the WAS agreement for the developer and their title;
also an address where Murray Construction is to send their invoice for payment.
