Attached are the Punch Lists generated and forwarded to Fain for the Cemetery's scope of work. Fain has been made aware of these conditions on several occasions and have been directed that all grades /beds adjacent to buildings should be lowered V-2" below brick ledge along with the inclusion of concrete splash blocks draining away from the building be installed at all downspout locations per specifications. Design elevations had been established and should allow for proper draining away from structures at all conditions. Again, we have reviewed on site the areas we have been made aware of and found in all cases where water has entered both at the columbarium and Funeral Home structures that the adjacent grades have been finished to an elevation 1" to 2" above the adjacent finish floor, brick ledges or door thresholds. We have been on site and spoken to Fain as recent as last Friday 06/06/09 concerning this issue and will reiterate once again that any damage as a result of failure to act on correcting these conditions will be forwarded to Fain to be replace /repair at no cost to the Owner. We will request a meeting for this Thursday. Where and when would be a convenient time and place for you to meet? Let us know and we will request Fain's attendance. Our Engineering Department has created a list of issues that need to be addressed by Fain also. Does Fain have this list? What is the latest development on eliminating the flooding of the landscape beds adjacent to the buildings causing water to get into the buildings? This situation is completely unacceptable. I prefer not to have a "french drain" type of solution as this is generally only a temporary fix. It appears that the building and /or drive elevations were designed incorrectly or installed incorrectly. It also appears that the landscaping is exacerbating the problem, with berms placed inappropriately, causing water to drain toward the building. Have you made an assessment? Please advise. Also, it appears that Fain has already exceeded their contract period by several weeks. Do you have a date of contract expiration, and of substantial completion? The city has Liquidated Damages included in it's contract with Fain, which appear to be growing daily. We are getting to a point in the project where these issues need to be settled. When would be a good time for us to get together with representatives from Fain to discuss? I have availability on Thursday morning or Friday morning of this week. Thanks. GENERAL: The second observation meeting was held on -site, Friday, May 15, 2009, at 8:00 a.m. The purpose of the visit was to perform an irrigation coverage test, and review delivered plant material and planting layout. We discussed the Landscape installation coordination with the Cemetery Project. The shrub /turf area mow strip (aluminum header) pending installation. B. IRRIGATION: Performed a Manual Irrigation Coverage Test at each valve box completed to date. Several Perimeter stations pending nozzle /head installation due to site construction RCV — M1 ,M2,M4,M5,M10,M11,M12,M13,M14. To be reviewed at next visit. Irrigation Controller pending installation and City programming coordination with Funeral Home. Contractor to continue to adjust nozzles during installation for over spray and adequate coverage. Mainline locations changed along entry road — locate on as- builts. Remote Control Valve and Quick Coupler assembly locations changed along entry road with mainline change— locate on as- builts. Sleeving changes to be indicated on as- builts. Install (2) mainline gate valves at parking lot entry drives per plans. May 20, 2009 RCV Station #9, add 15F in center of turf planter. Additional shrub exchange count to be taken from under naturalized tree planter areas. These Areas are to be left natural with natural shrub /vegetation growth.
