Ken,
The landscape contractor has been working on the area in question around the columbarium. We will
check the grades after he is finished but it appears to be a minimal slope from the building which may
require a revision to this area to fix the water issue. We can look at it on Thursday when you are on site.
As you are aware, we had a late change on the electrical main power supply. The drawings had one
meter shown for the entire site and the City requested separate metering between the City and Restland.
We had a meeting onsite with all parties including ONCOR on April 2, 2009 to see what the most efficient
way would be to split the system so we could get two meters. You sent an email on April 21, 2009 stating
you had reviewed the change order request we had priced for the electrical and would issue it in the next
owner change order. Based on this email we proceeded with the work to avoid any further delays to the
project and to date we have not received a change order for this work. The meter for the Columbarium
was set on May 6, 2009. We had stated in several meeting that we needed at least a week after the
meter to get the HVAC system up and running. The electric was the only issue keeping the Columbarium
from being substantially complete before this time. Tom moved in to the columbarium roughly a week
after the power was on. The lack of power also delayed the startup and testing of the irrigation system
due to no power for the controller. This in turn delayed the inspection by the Landscape Architect until
May 15, 2009 and the planting of landscape material. It is my understanding the City wants Stewart
Enterprises to pay for the electrical meter work based on an agreement they have with Stewart
Enterprises. It does not matter to us which party pays for this change. However, either way both projects
were delayed due to this change in the primary power and need to have days added to the contract. It
delayed the Cemetery project past the contract completion date. The following is a breakdown of the
days:
Permanent Power - 47 calendar days
HVAC startup on columbarium - 7 calendar days
Irrigation controller wiring/startup 11 calendar days
Landscape15 calendar days (landscape delayed
due to no
irrigation)
Set Lot Pins 10 calendar days from time irrigation can be
reduced to allow surveyor to
work (request by City not to work until this
time)
Scheduled for June 15, 2009.
At this time we are only requesting the days be added to the contract for completion date of June 25, 2009
assuming the City approves reducing the watering schedule on the hydro-seeding by June 15, 2009 to
allow it to dry out enough for the surveyor's to do their work on the change order for the lot pins. If the
irrigation cannot be adjusted on June 15, 2009, it will need to be ten (10) days past the date the irrigation
can be adjusted.

We have requested that the remainder of the cemetery be punched tomorrow for architectural items
outstanding, specifically the Pavilion building & entry gates. Attached are the Punch Lists generated and
forwarded to Fain for the Cemetery's scope of work.
Fain has been made aware of these conditions on several occasions and have been directed that all
grades/beds adjacent to buildings should be lowered 1"-2" below brick ledge along with the inclusion of
concrete splash blocks draining away from the building be installed at all downspout locations per
specifications.
Design elevations had been established and should allow for proper draining away from structures at all
conditions. Again, we have reviewed on site the areas we have been made aware of and found in all
cases where water has entered both at the columbarium and Funeral Home structures that the adjacent
grades have been finished to an elevation 1" to 2" above the adjacent finish floor, brick ledges or door
thresholds. We have been on site and spoken to Fain as recent as last Friday 06/06/09 concerning this
issue and will reiterate once again that any damage as a result of failure to act on correcting these
conditions will be forwarded to Fain to be replace/repair at no cost to the Owner.
We will request a meeting for this Thursday. Where and when would be a convenient time and place for
you to meet?
Let us know and we will request Fain's attendance.

Has J Stewart Todd developed a complete punch list from which Fain is working? Our Engineering

Department has created a list of issues that need to be addressed by Fain also. Does Fain have this list?
What is the latest development on eliminating the flooding of the landscape beds adjacent to the buildings
causing water to get into the buildings? This situation is completely unacceptable. I prefer not to have a
"french drain" type of solution as this is generally only a temporary fix. It appears that the building and/or
drive elevations were designed incorrectly or installed incorrectly. It also appears that the landscaping is
exacerbating the problem, with berms placed inappropriately, causing water to drain toward the building.
Have you made an assessment? Please advise.
Also, it appears that Fain has already exceeded their contract period by several weeks. Do you have a
date of contract expiration, and of substantial completion? The city has Liquidated Damages included in
it's contract with Fain, which appear to be growing daily.
We are getting to a point in the project where these issues need to be settled. When would be a good
time for us to get together with representatives from Fain to discuss? I have availability on Thursday
morning or Friday morning of this week. Thanks.
