Dear David:
As 1 am sure the staff has kept you aware, the process of getting the negligibly different
model from the Corps and for FLMA will take a.period of at least another week or so for them to
get copies of the precise model to us. Apparently the model which they now indicate that they
.wanted is basically the wane one that has been used by everyone and by the Kimley -Horn folks as
, ,yell as the City making its assessments and was also the one used by our engineer. Since they have
now managed to throw a hook in the works, Mr. Hawkins has instructed his engineers to work as
promptly as possible to get everything in order so that both FEMA and Ken may be satisfied-
The reason l am writing this letter is to see whether or not civilized behavior can still prevail
in this matter because it is definitely causing a delay and cost and detriment to the project by holding
up some of the grubbing, pad sites, et cetera, in the din work that needs to be done on the property
because the City has made what we understand to be a blanket order that such not be done anywhere
in or near the flood zone that everyone knows will be significantly modified.
I am writing this letter in an effort to see whether or not things can be put on an even keel and
functioning so that we could go ahead with the previous understanding that would allow such
grubbing, pad sites, et ceteM to be started and carried out in areas that everyone has agreed and
presumably still agrees will be perfectly acceptable as soon as the proper papenvork is filed.
Since all the engineers and the City staff have always agreed that this area will be subject to
a flood plain amendment and basically what it will be, it seems most odd that this project is being
treated in this manner and creates an apprehension that the project is being "singled out" and
certainly does not help in resolving various levels of disappointment over the hearing and the way
things were handled or not handled - by the way, although I would daresay that someone was
supposed to have sent us a copy of all this after the meeting - because we did request it - no one has
seen fit to send us copier, of the procedures that were enacted just before our hearing began. You
might check with staff and see if they can send us a copy or if you would be so kind as to send us
one.

David, please let me know as soon as possible °about this since we are being put in a very
difficult position and need to know exactly what the City is going to do with regards to a variety of
things that were threatened at the hearing - some of which T believe you will agree were quite illegal -
and we would like to be able to assure the business pariners and investors in this matter that their
considerable expenditure in the City of Coppell is not being frustrated by what seems at least to be
some sort of animosity.
I've, left a message with your paralegal and I understand that you will be back•in the office
sometime around noon today. Please give me a ring on my cell phone so that we can discuss this
and see what may be possible to work out and to see if may be possible to put this on an even keel,
et cetera.
