Corp. is the current owner of a 18.506 acre tract of land, which has a 20' wide sewer easement on and across the property, with the physical configuration being described by the attached Plat Exhibit " A " and the Boundary Description Exhibit "B ". Said 18 acre tract was conveyed by virtue of a Special Warranty deed from Carol Vesey, et al and was recorded within the Official Public Deed Records of Dallas County, Texas by Document No. 200600465947 on December 18, 2006. The City makes no claim for public use of said sewer line within the 20' easement. Having been given written permission to abandon said easement and sewer line by Ken Griffin, PE, Director of Public Works by virtue of a letter dated October 23, 1992, Exhibit "C" and an e-mail dated November 8, 2006, Exhibit "D" both of which are attached and made a part hereof. Since the City of Coppell hereby relinquishes any and all claims of useage or maintenance of said sewer line and/or occupation of said 20' easement, it is the express desire of Mira Mar Dev. Corp., as the owner of record and by virtue of the written authority granted by the attached City documents, the undersigned herein declares that said easement is hereby and forever after ABANDONED and as such will not appear on any plats, related to this property, after this document has been recorded. Griffin, P.E., City Engineer SUBJECT: Grapevine Sanitary Sewer Project DATE: October 23, 1992 On October 20, 1992, I met with Ms. Ruth Alexander and her daughter, Carol Vessey, concerning the acquisition of an easement across her property at the northwest corner of Bethel Road and Denton Tap. The City needs an easement across the east side of her property, parallel to Denton Tap, from Grapevine Creek to Bethel Road to construct a portion of the sanitary sewer line. There is currently a sanitary sewer line on the west side of Ms. Alexander's property, where Grapevine Creek goes under Bethel Road, that goes northward along the north side of her property and the south side of Grapevine Creek. In essence, it is on the west and north side of her property. Ms. Alexander stated that she would like to eliminate the portion of the sewer line on the north side of her property. This is a feasible alternative, however, there would be some cost to the City. The cost would involve relaying the portion of the sewer line on the west side of her property, which flows south to north right now. It would be relayed to flow in a north to south direction to the proposed sewer line in Bethel Road. The lenght is approximately 370 feet. By doing that, we could eliminate the portion of the sewer line on the north side of her property. However, if the sewer line on the west side is relayed, the proposed sewer line in Bethel Road would have to be upsized from a 24 to a 30 inch sanitary sewer line. Without the redesign of the sewer, Ms. Alexander has strongly indicated that she will not grant an easement for the proposed sewer line on the east side of her property and that she would fight us in court when we try to obtain it. The following is a summary of what Ms. Alexander would like: 1) Relay approximately 370 feet of the sanitary sewer on the west side of her property to flow in a north to south direction . 2) Abandon the sanitary sewer on the north side of her property. 3) Install a new chain link/barbed wire fence with a chain link gate on the east side of her property, parallel to Denton Tap Road. 4) Reseed any construction area with bermuda grass. 5) This is an offshoot of relaying the sewer on the west side. The sanitary sewer in Bethel Road would have to be upsized from a 24 to a 30 inch sanitary sewer. In return, the City would obtain the following from Ms. Alexander: 1) The 20 foot permanent utility easement on the east side of her property. 2) A 40 foot temporary construction easement on the east side of her property. 3) A 40 foot temporary construction easement on the west side of her property. Ratliff, City Manager October 23, 1992 Page 2 The cost to relay the sanitary sewer line and to upsize the proposed sewer line in Bethel Road would cost the City somewhere in the range of $30,000 to $40,000. As I stated in a previous memo, I will be briefing the Council on November 10, 1992 concerning the bid opening and various options associated with this project. At that time, unless you offer any objections, I will present this request from Ms. Alexander as an additional option for the Council to consider and provide direction on. The sewer flowed from west to east and was placed to provide sewer service to most of the 1967 existing city limits of Coppell that was west of Denton Tap Road. In 1991, the City of Coppell authorized the design of a new sewer line that would replace the existing 12" sewer line with a 24" sewer line in generally the same location along the south side of Grapevine Creek. However, during public meetings concerning the project, there was much discussion about how placing the new sewer line along Grapevine Creek would destroy numerous trees, especially east of Denton Tap. In 1992, the City Council authorized the redesign of the new 24" sewer line away from Grapevine Creek to the middle of Bethel Road. Page 2 of 2 With the construction of the 24" sewer line in 1993/94, the City abandoned the portion of the old 12" sewer line on the west side of the Alexander Tract. (Attached is a copy of my October 23, • 1992 memo to the City Manager, that was also presented to Council, that outlined the abandonment of the 12" sewer line across the Alexander Tract.) The old 12" sewer line along the north side of the Alexander Tract is still in place, but it only exist to serve the Alexander Tract. If the development of the Alexander Tract does not utilize the old 12" sewer line, then it can be abandoned. If it is abandoned, then the easement on the site could also be abandoned with the replatting of the property.
