In your letter of February 18, 1998, you state that the City has concluded that the compaction in the trench line does not meet the 95% density requirements as evidenced by a geotechnical report prepared in late 1997. My client is and remains of the opinion that the reason for the failures in the roadway are not the result of alleged deficiencies in the compaction of the trench line but rather is the result of inadequate drainage provided by the City on the sides of the road. As you know, all of the work of the contractor on this project was subject to inspection and testing by the City 0fCoppell. The City approved all work (including specifically the compaction of the trench) performed by my client. In addition, my client performed independent testing of its backfill operation to insure compliance with the contract specifications. Attached to this letter are copies of the test reports which clearly evidence that the backfill in the trench was, in every instance, compacted to at least 95% density as required by the contract. Without attempting to address or dispute the results of the test report provided in your February 18th letter, the fact that the trench may or may not test at 95% compaction at the present time is no evidence of its earlier compaction at 95% density. In fact, as evidenced by the enclosed test reports, the entire trench line was compacted per the Contract Documents. For this reason, Pate Brothers Construction, Inc. maintains it has no responsibility for the present condition of the road and, as previously communicated to your office, believes that the reason for the failure is the nearly Canterbury, Stuber, A PROFESSIONAL CORPORATION Kenneth M. My client had no responsibility for providing positive drainage in those ditches and is therefore not responsible for the resulting damage which that constant exposure to water may have caused.
