Mira Mar does not have the authority to abandon our easement. The City is in the process of abandoning the easement. The note on the plat should say that the easement will be abandoned by separate document. The 'official" DRC comments from both Engineering and Planning (sent to the applicant on 12/28) state that the abandoned easement should be graphically shown on the plat. Has Mr. Hawkins been notified that his abandonment is not valid? Do we need to add an addendum to the DRC comments to indicate that he needs to revise his plat to show the existing sewer easement (until legally abandoned) - similar to the "legal" flood plain.
