These failures are a direct result of water sitting in the drainage ditches that are either plugged or do not drain due to the improper elevations of the ditch. This sitting water saturates the trench backfill to the point that it is unfit for backfill. -The road in these areas will fail again after the next several rains where the water stays in the ditch due to improper drainage. Pate Brothers will stand by any failures that are a result Of our workmanship. The areas that have either no drainage or poor drainage will need to be addressed by other means. Kermedale, TX 76060 Re: Bethel Road Sanitary Sewer Line SS 94-02C Dear Mr. Bisballe: Over the past several months the new asphalt overlay on Bethel Road has experienced severe cracking and failures over the trench line of the sanitary sewer line that was installed by Pate Brothers on the south side of the road. These failures have created unsafe driving conditions which has required the City to place temporary asphalt patches over the sink holes in the pavement. Occasionally, Pate Brothers has sent someone out to perform repairs on the roadway only to have failures reoccur in the same place. Also, some of the cracks have propagated onto the north side of the road. On Tuesday October 8, 1996 Garreth Campbell, Construction Inspector for the City of Coppell, scheduled a meeting with Bruce Shear of Pate Brothers to walk thru this project to determine what options were available to resolve the failure problems. Ken Griff'm, Garreth and myself met at the project site for the meeting with Bruce. Bruce never showed up. I hope this was an oversight on Bruce's part and not an indication that this issue is not a concern to Pate Brothers. This letter should serve as notice that the City of Coppell is requesting Pate Brothers to determine what is causing the road to fail. Among other things, this should include TVing the new sanitary sewer line to determine if there are separations in the line. Pate Brothers should then submit to the City a solution for the continuing asphalt failures occurring over the sanitary sewer line. Kennedale, TX 76060 Grapevine Creek IV Sanitary Sewer Line SS 94-02B Dear Mr. Bisballe: Thank you for taking the time to discuss the Grapevine VI Sanitary Sewer Project and Bethel Road Sanitary Sewer project with me today. Based on that conversation, I understand that you will be moving back onto the Grapevine iV project during the last week of August to complete the last section adjacent to Denton Tap Road which includes the siphon. During our conversation, you also expressed some concern about the punch list items on Bethel Road. As I stated, I will have Garreth Campbell look at that project again to determine if there are still any outstanding punch list items. The one item that we did discuss on Bethel Road that has caused me concern is the continuing failures in certain sections of the roadway. It is my understanding that this will be addressed when you move back in on the project. Kennedale, TX 76060 Re: Bethel Road Sanitary Sewer Line SS 94-02C Dear Mr. Bisballe: I received your fax on July 26, 1996 and did attempt to contact you at 5:30 p.m. on that same day. I will be out of town the week of July 29 through August 2 and will be back in the office on August 5, 1996. I am somewhat confused about the $8,000 mentioned in your letter. Our last estimate #4 was very clear in the fact that we had a 500 foot agreement in the amount of $4,000. This was included with our last pay estimate. It is my understanding that that check has been accepted by Pate Brothers Construction, Inc. During a meeting attended by you, Mike Martin, Garreth Campbell and myself we discussed what it would take for you to walk away from this section of the project. It was our opinion that to correct the problem would require at least 970 feet of pipe to be relaid. It was our understanding during that meeting that you stated it would take $4000 to walk away from the project. At no time either before, during, or after that meeting was there any conversation about paying or not paying for trench safety. Taking trench safety out of the mix, the only difference between the $4,000 agreement and the $8,000 proposal is approximately $325. If in fact your intent is to also be paid for trench safety then there is an approximate difference of $4,000 from what you have accepted as payment and what you are requesting to be paid. Please verify that number in writing to the City. I want to be very clear on one other comment in your letter. You stated that if there was any misunderstanding about this offer then you would reinstall the portion of the sewer line that is unacceptable to the City per plan grade. Please be advised that with your knowledge that section was reconstructed by another contractor and therefore you are not authorized to enter upon the sewer line project west of Freeport Parkway. Your f'mal on that section has been completed and the check has been accepted by your company. Also, you are aware that your bonding wil! stop at Freeport Parkway and you will not be bonding the section of the project west of Freeport Parkway. So again, you are not authorized to enter that section of the project to reconstruct the sewer line referenced in your letter. If you are concerned about the sewer line being installed to plan grade, I would request that you resurvey each and every manhole along the stretch of this project to insure that all of it has been constructed to plan grade. This request is predicated on the fact that you are concerned about it being installed to plan grade and the fact that you have indicated that some of the sewer line is deeper than what the plans show. I am also concerned about whether or not the sewer line was installed deeper than the plans showed. If you are able to mobilize bY August .6, as your letter states, then I would request that you mobilize and complete the section of Grapevine IV adjacent to Denton Tap Road that includes the siphon. As has been stated to you previously, we have acquired that easement and we have agreed to the mobilization fees for that construction. Also, when you mobilize we need you to revisit the section of Bethel Road east of Freeport. We are continuing to have problems with the settling of the ditch line and request that this be corrected along with the construction of the siphon. In summary: 1) You are not authorized to work west of Freeport Pkwy. as we released the retainage and f'maled out that section and you are no longer the contractor on that section; 2) If you can mobilize, I request you mobilize on August 5 and start the construction of the siphon adjacent to Denton Tap Road; 3) Any discussion concerning the payment of trench safety, in addition to the credit offered to the City, needs to be discussed when I have return to the office; 4) When you remobilize on this project you need to also address the continuing failures with the trench along Bethel Road. The only section that is finaled is from Freeport Parkway, Sm. 42+52 to the west to Sm. 74+72 or 3,220' minus 500' as agreed upon, a total of 2720' of 10" PVC. This final includes all items associated with that 2720', plus $4,000.00, a previously agreed upon amount that allowed for the acceptance of that section of the project as completed. Of the 2720' of pipe, 200' is 0'-10' bury and 2520' is 10'-15' bury according to the cutsbeet and plans. There are manholes at Stations 47+27, 52+22, 57+16, 61 +54, 63+66, 68+32, 72+86 and 74+72 (eight manholes, seven 4' and one 4' drop). There was one C.O. abandoned at Sta. 46+80. Also, included is 2720' of trench safety and 43% of traffic control. Bethel Road Sta. 0-08 to Sm 42+52, includes 12" from 0-08 to 0+40 (48') from 1+62 to 35+40 (3378) for a total of 3426', and 10" from Sta. 35+40 to 42+52 or 712'. Enclosed for your review is a breakout of these items on our standard estimate form. I hope this information is helpful. I acknowledge that a walk thru has been done on the section from Sta. 0-08 to Sta. 42 +52 and a punch list was generated. However, not all the items on the punch list have been resolved. Once all the punch list items are resolved, that portion will be considered to be complete, but the retainage will not be released until Grapevine IV is completed and accepted. I would like to also take this opportunity to inform you that the pavement over the ditch line is continuing to settle in some areas.
