As we have discussed, the City is currently constructing a new sewer trunk main from MacArthur Blvd., in the east, to Southwestern Blvd., in the west. The construction has begun and the contractor is in the process of clearing a path to do surveying and to string out materials along the path of the new installation. The City is requesting a 40 foot temporary construction easement south of the existing 20 foot sanitary sewer easement on your property. An exhibit is included showing the location of the temporary construction easement. Also, included is a portion of the plans that show the construction of the sewer line on your property. This information was previously provided to you in November, 1992. The project is nearing a point where it is imperative that the City obtain this temporary easement. As previously mentioned, the City has an existing 20 foot sewer line easement where the sewer line will be placed; however, there is a need to maneuver along the permanent easement for construction purposes. The temporary construction easement will go away once the project has been completed. The contractor will make every attempt to return the area back to its preconstruction condition. Because of the critical nature of the project, the City would appreciate an expedient response to this request. Please return the temporary construction easement with your notarized signature to the City of Coppell for our records. Also, for your convenience, the Engineer Department does have a notary public on-site and would be more than happy to notarize this document for you. TEMPORARY CONSTRUCTION EASEMENT STATE OF TEXAS § § KNOW ALL MEN BY THESE PRESENTS: COUNTY OF DALLAS § THAT the term Grantor used herein shall be construed in the singular or plural number as such term respectively represents one or more than one person. Said temporary easement strip being described in Exhibits "A" and "B" attached hereto and made a part hereof for all purposes. That in consideration of the benefits above set out, Grantee will remove from the temporary easement strip, such fences, buildings and other obstructions as may be found upon said property. After construction of the underground sewer line has been completed, GRANTEE shall, except for removed obstructions, return the surface area of the temporary easement strip to its original condition as nearly as practical taking into consideration the nature of the work being performed and the temporary construction easement shall terminate and GRANTEE shall not be obligated for future maintenance and upkeep of the surface area.
