HEARING DATE: October 13, 2009 STAFF REP.: Marcie Diamond, Assistant Director of Planning LOCATION: SWC of S.H. 121 and Denton Tap Road, west of Viewpoint Bank SIZE OF AREA: 2.0 acres of property CURRENT ZONING: PD- 133 -HC (Highway Commercial) REQUEST: A minor plat to allow the conveyance of this tract as a platted lot. George Bush Highway Garland, Texas 75040 972- 238 -5454 FAX: 972 - 238 -5414 HISTORY: This property was zoned PD- Highway Commercial in the mid - 1990's as part of an 87 acre tract zoned for single family and flood plain /park uses. The initial application for this PD indicated single family for the areas adjacent to S.H. 121 and Denton Tap Road. However, Highway Commercial zoning was ultimately established on this tract to provide a buffer between the residential and the high- traffic intersections. ITEM # 9 Page 1 of 3 On February 17, 2000, the Planning and Zoning Commission recommended denial of a Special Use Permit for a Burger King restaurant on Denton Tap, north of Natches Trace Drive. This request was not appealed to City Council due to overwhelming opposition by the residents in the Magnolia Park subdivision. In November 2002, Council approved S -1174 for Deliman's Grill on this same parcel of land. On May 9, 2000, Council approved the detail plan for a 15,600 square -foot retail building on approximately 2.1 acres of property fronting Denton Tap Road, south of S.H. 121. On December 11, 2001, Council approved a detail plan for a 6,000 square -foot Community Credit Union, which is now Viewpoint Bank, at the southwest corner of Denton Tap and S.H. 121. TRANSPORTATION: Denton Tap Road is a P6D, six -lane divided thoroughfare contained within a 100 -120 foot right -of -way. S.H. 121 is built to freeway standards within 450 feet of right -of -way. SURROUNDING LAND USE & ZONING: North- SH 121 and PD- 240 -HC, North Gateway Center (retail, restaurant and office) South - Single- family; PD- 133R -SF -9, Magnolia Park East -Viewpoint Bank; PD- 133R3 -HC West - Undeveloped land; PD- 133 -HC COMPREHENSIVE PLAN: The Comprehensive Plan shows the property as suitable for Freeway Commercial Uses DISCUSSION: The sole purpose of this platting activity is to allow the conveyance of this 2.0 -acre tract as a separately platted lot, in accordance with state law. This minor plat meets the requirements to allow for filling for record in the appropriate county. The applicant has submitted a concept /illustrative plan indicating indoor commercial amusement and restaurant as potential future uses for this property. The owner and the prospective purchaser are fully aware that prior to development of this property, this land must be rezoned through a public hearing process. Specifically, an amendment to PD- 133 -HC will be required, which establishes a Detail Site Plan for this tract. This Detail Site Plan must include site plan, landscape plan and elevations. This property must also be replatted to provide required ITEM # 9 Page 2 of 3 preliminary engineering, fire lanes and easements. It is recommended that these processes run simultaneously. RECOMMENDATION TO THE PLANNING AND ZONING COMMISSION: Staff is recommending APPROVAL of Magnolia Retail Addition, Lot 1, Block A, Minor Plat subject to this property being rezoned and replatted prior to development. ALTERNATIVES: 1. Recommend approval of the request 2. Recommend disapproval of the request 3. Recommend modification of the request 4.
