Dear Sirs,
I reside at 726 Bankers Cottage Ln at the North end of the canal that runs through Magnolia Park subdivision.
Last week, a retaining barrier was erected in the water approximately 80 ft south of the underpass (where
incoming water would be flowing into the canal). The construction was commissioned by the Magnolia Park
HOA President without the knowledge or consent of the HOA membership. His thought was to create a
containment area to collect the dirt and debris washing in from the underpass and limit the area that needs to
be dredged on occasion.
My concerns are numerous:
-Has this construction been authorized by the City and has a permit been obtained?
-Will this “dam” create added pressure to the canal sidewalls when filled with dirt, vegetation and
water, and thus compromising the structural integrity of the canal and ultimately the foundation of my
house?
-Will this “dam” restrict the natural flow of water in a heavy rainstorm and cause backflow into the
underpass and beyond?
-The containment area (between the underpass outlet and the dam) will turn that section of the canal
behind my house into a trash/dirt collector, deflating the value of my property and those of my
immediate neighbors.
I wish to bring this matter to your attention and respectfully request an inspection of this construction to answer
my concerns listed above. I have also brought this matter to the attention of the Magnolia Park HOA
membership who is equally concerned.
