I have sent you the letters that we have exchanged lately I don't know if you got them but they were faxed to the city to your attention. The bottom line is money was deducted from my progress payments and money was also withheld for a section of the wall that failed. The repairs can not be completed because the material was used by another subcontractor that was hired by NTB. That material was paid for with money from my progress payments. My point is that I have tried to fulfill the contract and can't get any cooperation from NTB or Tiseo Paving. I will be in Dallas next week to see what my legal options are. I can't afford to just let this go. I can be contacted at 580-512-8771. I would like to hear from someone with the city of Coppell before I go to Dallas next week.    Lee Gilmore Alterra Contracting LLC ----- Original Message ----- From: Ken Griffin To: LEE Cc: Paula Crocker Sent: Tuesday, September 05, 2006 3:16 PM Subject: Re: Sandy Lake Road. Mr. Gilmore   I have received your email and have asked my project inspector to provide me additional information on the situation.  The City does not usually become involved in situations between the contractor we hire and his subcontractors.  However, at the end of a project, before we release the final retainage on the project, we require our contractor to provide us an affidavit that all bills have been paid.    When I have more information I will get back in touch with you.   Ken Griffin, P. I am the owner of Alterra Contracting LLC. We were contracted to build the retaining wall on Sandy Lake Road by North Texas Bridge Co. who was a subcontractor to Tiseo Paving. I have not been paid for work completed and material used by NTB on the job. I would like to discuss this matter with someone from your office. We have tried several times to talk to Garreth but he will not return calls or emails. Tiseo and North Texas Bridge will not answer any calls or emails as well.   I have several letters concerning the problems on the job that led to Alterra not being allowed to complete the job. We had a section of wall that failed and were told by John Gay with Tiseo to repair it after all other work was completed due to traffic control. We were never allowed to complete the work and therefore never allowed to make the repairs. Money was held back for repairs that we were not allowed to do. North Texas Bridge also used material on the remaining wall that was property of Alterra Contracting. There are a number of issues file://C:\Documents and Settings\radloo\Local Settings\Temp\XPgrpwise\4B4B5B41City_...7/27/2010 Page 2 of 2 that were not in our control but contributed to our problems. Please at least contact me to discuss this in detail. If I don't hear from someone soon I will be filing a lien or taking other action to collect. We are a small company and can't afford to let this continue.   Respectfully, Lee Gilmore   580-228-3226 580-512-8771 file://C:\Documents and Settings\radloo\Local Settings\Temp\XPgrpwise\4B4B5B41City_...7/27/2010
