EVALUATION OF ITEM: DATE: January 30, 1990
Attached is a correspondence from Mr. 3ones along with related
documents, making a pay request on City's portion of Samuel
Boulevard. Please note that the cost covers drainage, paving,
and excavation cost of Samuel Boulevard and related inspection
fees.
The estimated total cost per the contract letter was $42,158.66.
The actual total cost is $45,430.84, a difference of $3272.18.
This additional amount was for additional quantities or items
that were not expected in the original, estimate in the contract.
The additional items were adjustment of an existing manhole,
lowering an existing water line, traffic control during, the
construction and traffic control buttons for the section of Samuel
Boulevard built for the City of Coppell. Additional storm drainage
pipe was necessary also.
Staff has reviewed this submittal and field verified the work
that was done.
Staff recommends approval.

Minutes of June 13, 1989
The City Council of the City of Coppell met in a special called
Executive Session on Tuesday, June 13, 1989, at 7:16 p.m. in the Council
Executive Chambers of Town Center. Those members present were:
Mark Wolfe, Mayor
Dean Wilkerson, Mayor Pro Tem (late arrival)

Item 16: Consideration of a Final Plat for the Meadows Addition,
Section Six, located at the southeast corner of Samuel
Boulevard and Parkway Boulevard at the request of DT
Construction.
Date of P&Z Meeting: 5-I8-89
P&Z Decision: Approved (6-0) as submitted.
Planning and Zoning Coordinator Taryon Bowman made the presentation to
the Council. Ms. Bowman stated that the Planning and Zoning Commission
has unanimously recommended approval of this final plat and that the
developer has agreed to construct Samuel Boulevard beginning at the
point north of Sandy Lake Road, where the existing four (4) lanes end
and continuing north along the existing two (2) lanes to the point on
Samuel Boulevard where the four (4) lanes begin again. Mr. Gordon
Jones, D.T. Construction Company, was also present to discuss this item
with the Council and indicated the developers intention to finalize
construction of Samuel Boulevard prior to the fall of i989 opening of
Lee Elementary. Following discussion on this item, Councilman Morton
moved to approve the final plat with the stipulation that Samuel
Boulevard be completed prior to the opening of school for the fall 1989
term. Mayor Pro Tem Wilkerson seconded the motion; motion carried 7-0
with Mayor Pro Tem Wtlkerson, Councilmen Thomas, Morton, Smothermon,
Cowman, Robertson and Nelson voting in favor of the motion.

Dear Shohre:
Per my telephone conversation with Gordon Jones, vice President of
D.T. Construction, please find enclosed the revised estimate for tho
improvements related tO the City of Coppell's participation of the
improvements surrounding the referenced development. This .estimate
has been revised as follows:
1) The quantity for traffic detour barricades, and the striping and
traffic buttons for Samuel Boulevard has been changed from 0.5 to
0.39 for both items.
2) The quantity for the 30 inch RCP Class III storm sewer pipe will
remafn as shown. The additional 45 feet is for the extra pipe
which was stuDbed out to the center of Samuel Boulevard. This
was requested by Kevin Pieffer, P.E. and Russell Doyle, P.E. the
night that the Final Plat was approved by the City Council oS
Coppell.
3) The lowering of the existing water line was required to extend
the 30 'inch storm sewer system to the conterlino of Samuel
Boulevard. It was not known that the waterline was to be lowered
until it was exposed during the construction of the s~orm sewer
syutem.
4) The unit price for the Class IV, 30 inch RCP storm sewer pipe has
been changed from $37.41 per foot to $31.41 per foot. The uniu
price originally s~own was for the 33 inch Class IV RCP pipe
which does not affect the Samuel Boulevard improvements.

5) All bonds have been paid as indicated by the City's receiving
these from each contractor after acceptance of the subdivision.
6) The Engineering fee for the referenced subdivision has been paid
by the developer.
7) The adjustment to the existing inlet has been deleted from the
estimate. This item was deleted as it does not directly affect
the improvements in.samuel Boulevard. However, it should be
discussed in the future by the City and the owner as it was
requested at the City Council meeting the night the plat was
approved. This inlet is downstream of the referenced development
as was not necessary for the Meadows Six Addition, but was
constructed for the City by the developer.

Re: Ctqnstruction Participation Agreement for
Samuel Boulevard between Sandy Lake Road
and Woodmoor Drive
Dear Mr. Ratliff:
As you are aware, we are building the remaining half of Samuel Boulevard
adjacent to our new subdivision, The Meadows Section Six. I thir~k you will
agree that it would be most economical to build the remaining portion, adjacent
to the Saint Anne's Church property, at the same time. Since the City of
Coppell (the "City") will be bearing the cost of that portion adjacent to the
church property, this letter is written for the purpose of establishing an
agreement under which the City is to pay D. T. Construction, Inc. ("I).T") for
the total costs incurred by D.T. in the construction of the City's section of
Samuel Boulevard.
In consideration of the mutual promises of the City and D.T. and the mutual
benefits to be obtained, the adequacy of which is hereby acknowledged, the
parties hereto enter into this Agreement under the following procedures and
conditions:
I. Within ten (10) days of the acceptance by the City of the improvements
for maintenance by the City, the City shall pay to D.T. the costs for
the City's portion of Samuel Boulevard, estimated to be:

2. All construction shall conform with the plans and specifications
attached as Exhibit C, as designed by Paul S. Unzicker, Inc.
3. D.T. shall manage the construction in a professional and expeditious
manner and agrees to comply with and abide by the conditions set out
in Exhibit "B' attached hereto, the' same being made a part of 'this
agreement as though set out herein verbatim.
4. The amount paid by the City shall be the actual cost incurred by D.T.
and shall be evidenced by the invoices submitted by the contractors to
D.T.
Mr. Ratliff, if this is acceptable to the City, please signify your approval by
executing this agreement in the space provided below and return a
fully-executed original hereof to D. T. Construction, Inc.

a. D. T. shall at all times remain an independent
contractor, solely responsible for the manner and method
of completing the construction of the project which is
the subject of this Agreement ("The Project"), with full
power and authority to select the means, method, and
manner of performing such work, so long as such methods
do not adversely affect the completed improvements, the
City being interested only in the result obtained and
conformity of such completed improvements to the plans
and specifications.
b. Likewise, D. T., its contractors, and subcontractors,
shall be responsible for the safety of themselves, their
employees, and other persons, as well as for the
protection of the safety of the improvements being
constructed and the property of themselves and any other
person, as a result of their operation in regard to The
Project. D. T., its contractors, and subcontractors
shall at all times exercise reasonable precautions for
the safety of employees and others near the work and
shall comply with all applicable provisions of Federal,
state, and municipal safety laws and building
construction codes. Attention is specifically directed
to the Texas Occupational Safety Law.
c. D. T., its contractors, and subcontractors shall at all
times during the construction period be responsible for
maintaining barricades, lighting, warning signs, warning
lights, flags and speed limit signs within the
construction area as is necessary to warn, safeguard and
protect vehicular and all other traffic using the roadway
within or approaching the construction area. D. T., its
contractors and subcontractors shall provide and maintain
flagmen at all points where operations interfere in any
manner with traffic flow. Flag~en shall be
English-speaking, courteous, well informed, physically
and mentally able effectually to perform their duties in
safeguarding and directing traffic and protecting the
work, and shall be neatly attired and groomed at all
times when on duty. Flagmen, when directing traffic,
shall use standard flagging procedures set forth in the
"Instructions to Flagmen" published by the Texas State
Department of Highways and Public Transportation. D.T.,
its contractors and subcontractors shall provide and
maintain such standard barricades or special barricades,
warning signs, speed signs, lights and flags at points
along The Project as may be necessary to protect the work
and safeguard all traffic. All signs, barricades and
working area layouts shall be provided and maintained in
accordance with requirements of Part VI of the Manual on
Uniform Traffic Control Devices, "Traffic Controls for
Street and Highway Construction and Maintenance
of traffic will be the responsibility of D. T., its
contractors and subcontractors. The use of sufficient
vertical panels with flashers in conjunction with
necessary warning signs and barricades will be required
to direct traffic.
d. D. T. shall defend, indemnify, and hold harmless the City
of Coppell, its respective officers, agents, and
employees from and against all damages, claims, losses,
demands, suits, judgments, costs or expenses, including
reasonable attorneys' fees and expenses, arising out of
or resulting from the performance of work within The
Project, provided that such damages, claims, losses,
demands, suits, judgments, costs or expenses are
attributable to bodily injury, sickness, disease or
death, or to injury or to destruction of tangible
property including the loss of use resulting therefrom;
and is caused in whole or in part by any negligent act or
ommission of D. T., any contractor or subcontractor, or
anyone directly or indirectly employed by any one of
them, or anyone for whose acts ans' one of them may be
liable.
e. D. T., at its own expense, shall purchase, maintain and
keep in force such insurance as will protect it from
claims set forth below which may arise out of or result
from D. T.'s construction within The Project, whether
such operations be by itself or by any contractor or
subcontractor, or by anyone directly or indirectly
employed by any one of them, or by anyone for whose acts
any of them may be liable:
(1) worker's compensation claims, disability benefits,
and other similar employee benefit acts;
(2) claims for damages because of bodily injury,
occupational sickness or disease, or death of its
employees, and claims insured by usual bodily injury
liability coverages;
(3) claims for damages because of bodily injury,
sickness or disease, or death of any person other
than its employees, and claims insured by usual
bodily injury liability coverages; and
(4) claims for damages because of injury to or
destruction of tangible property, including loss of
use resulting therefrom.
f. Before commencing work within The Project area, D. T.
shall file with the City valid certificates of insurance
acceptable to the City. Such certificates shall contain
a provision that coverages afforded under the policies
will not be cancelled until at least fifteen (15) days'
prio~ written notice has been given to the City. D.T.
shall also file with the 'City valid certificates of
insurance covering all contractors and subcontractors.
g. D. T. agrees that it will indemnify and save the City
harmless from all claims growing out of the lawful
demands of contractors, subcontractors, laborers,
workmen, mechanics, materialmen and furnishers Of
machinery and parts thereof, equipment, power tools, and
all supplies, including a commissary, incurred in the
furtherance of the performance of this Project.
h. D. T., its contractors and subcontractors shall take
proper means to protect adjacent or adjoining property or
properties in any way encountered which might be injured
or seriously affected by any process of construction in
regard to The Project, from any damage or injury by
reason of said process of construction, and D. T. shall
be liable for any and all claims for such damage on
account of such failure to fully protect all adjoining
property and further agree to indemnify, save and hold
harmless the City against any claim or claims for damages
due to any injury to any adjacent or adjoining property,
arising or growing out of the performance of the
construction within The Project.
i. D. T. agrees to be responsible for or require its
contractor to be responsible to maintain, repair and
reconstruct The Project in whole or in part for a period
of twelve (12) months after acceptance of The Project by
the City in the event of any failure due to defective
· materials or wormanship.
j. D. T. agrees to require its contractor to execute
separate performance and payment bonds, each in the sum
of one hundred (100) percent of the total contract price
between D. T. and its contractor, in standard forms for
this purpose, guaranteeing payment of all persons
supplying labor and materials or furnishing any equipment
in the execution of the contract, and further providing
that said ~urety on ~uch bonds shall be held firmly bound
to D. T. and the City of Coppell in said sum,
guaranteeing faithful performance of the work and the
fulfillment of the guarantees set forth in paragraphs (g)
and (i) above. The surety on each bond must be a
responsible surety company which is qualified to do
business in Texas and satisfactory to the City of
Coppell.

Subject: Samuel Boulevard Improvements
On February 2, 1988, Council approved $30,000.00 for the completion of
Samuel Boulevard.
I have reviewed the minutes and have been unable to find where Council
agreed to pay for St. Anne Catholic Church's portion of Samuel
Boulevard. It would appear that in order to remain consistent with City
policy of not assessing any churches for road assessments we need to
take $15,431.00 out of C.I.P. surplus funds to pay the final payment to
D.T. Construction.

Item 9: St. Ann's Catholic Church - Revised Final Plat

Mayor: How about the assessments for the road Father, I'm
wanting to be sure that the Church is not caught in the middle
of a contractural obligation to provide, someone is being let
out of an obligation for assessment on conetruction of the road
because of an obligation of the Church to go in and say, we are
a Church, we are not assessed for those kinds of things.
Applicant: My understanding of~ about that is that at the
purchase of the second tract of property, which was divided into
two, an A and B tract, or the second little narrower strip,
there was an appendum to that contract, that stated that the
Church, because of a mutual interest in roads and development,
that the Church would pay for half the cost of development or
improving that property.
Mayor: Of Woodmoor?
Applicant: Of Woodmoor, they also said Samuel, but itw was
appended after the Samuel agreement was already, after we
already purchased the property.
Mayor: $o the Church does have responsibility, yall are going
to have to pay for 1/2 of Woodmoor and 1/2 of Samuel, is that
correct?
Applicant: No not half of Samuel.
Mayor: Not half of Samuel?
Applicant: No, I don't think so.
Mayor: All right, because you wouldn't be assessed because you
are a Church; however, the former land owner had that
obligation, is that not correct?
Applicant: I can't speak to that, I mean I don't know. That

Planning and Zoning Coordinator Taryon Bowman made the presentation to
the Council. She stated staff recommends denial due to City's
requirements not being resolved. Father Broderick, representing St.
Ann's Catholic Church, was present and discussed this item with the
Council. Jay Turner, Attorney made a presentation on behalf of the
applicant. Applicant Paul Unzicker was also present to discuss this
item. Steve Morton, Chief Developmental Inspector addressed the Council
concerning requirements of the applicant from the City's perspective.
Following discussion of this item Councilman Wolfe moved to approve the
final plat for St. Ann's Catholic Church with the acknowledgement that
they will pay their one-half cost of Woodmore Drive at the time it is
built, pay for the four-hundred (400) linear feet of the water line from
Samuel to Woodmore to the water connections and that a future developer
building Woodmore Drive will pay for the remainder of the cost from the
connection to the east extension of the property line, and in addition,
the church is not entitled to pro-rata on the part that is built.
Councilman Smothermon seconded the motion. Following further discussion
Councilman Wolfe restated his motion. Councilman Wolfe moved to approve
the re-submittal of a final plat for St. Ann's Catholic Church with the
acknowledgement, in writing from the diocese, that they will pay for
one-half (1/2) of the Woodmore Drive cost that abuts their property
line, they will pay in whole, the cost of the water line from Samuel
Boulevard, four-hundred (400) linear feet east to the water connect,
however, the remainder water line to the water connect, four-hundred
(400) feet east to the end of the property line, will be the
responsibility of future developers and no pro-rata will be charged.
Councilman Smothermon again seconded the re-stated motion; motion
carried 6-0 with Mayor Pro Tem Wilkerson, Councilmen Pettijohn,
Smothermon, Cowman, Wolfe and Nelson voting in favor of the motion.
Item 10: Discussion and consideration for approval of expending $500.00
for the City Employee Annual Picnic.
Councilman Pettijohn moved to approve expenditure of $500.00 for the
City Employee Annual Picnic. Councilman Smothermon seconded the motion;
motion carried 6-0 with Mayor Pro Tem Wilkerson, Councilmen Pettijohn,
Smothermon, Cowman, Wolfe and Nelson voting in favor of the motion.
Item 11: Discussion to consider approval of contract between the City of
Coppell and the North Texas Commission for the purpose of
developing regional programs both on a national and
international level to market the North Texas Region, which
includes Dallas County and the City of Coppell and pay to the
Commission the sum of $1,105.00 per annum for such services and
authorizing the Mayor to sign.

Minutes of June 13, 1989
The City Council of the City of Coppell met in a special called
Executive Session on Tuesday, June 13, 1989, at 7:16 p.m. in the Council
Executive Chambers of Town Center. Those members present were:

Item 16: Consideration of a Final Plat for the Meadows Addition,
Section Six, located at the southeast corner of Samuel
Boulevard and Parkway Boulevard at the request of DT
Construction.

P&Z Decision: Approved (6-0) as submitted.
Planning and Zoning Coordinator Taryon Bowman made the presentation to
the Council. Ms. Bowman stated that the Planning and Zoning Commission
has unanimously recommended approval of this final plat and that the
developer has agreed to construct Samuel Boulevard beginning at the
point north of Sandy Lake Road, where the existing four (4) lanes end
and continuing north along the existing two (2) lanes to the point on
Samuel Boulevard where the four (4) lanes begin again. Mr. Gordon
Jones, D.T. Construction Company, was also present to discuss this item
with the Council and indicated the developers intention to finalize
construction of Samuel Boulevard prior to the fall of 1989 opening of
Lee Elementary. Following discussion on this item, Councilman Morton
moved to approve the final plat with the stipulation that Samuel
Boulevard be completed prior to the opening of school for the fall 1989
term. Mayor Pro Tem Wilkerson seconded the motion; motion carried 7-0
with Mayor Pro Tem Wilkerson, Councilmen Thomas, Morton, Smothermon,
Cowman, Robertson and Nelson voting in favor of the motion.
16C. Consideration of awarding a contract to construct and install
landscaping and irrigation in the medians of Denton Tap Road
from the intersection of East Beltline Road and Southwestern
Boulevard to Denton Creek to the Iow bidder, Landscape Design
and Construction, in the amount of $148,432.00 and authorizing
the Mayor to sign.
16D. Discussion and consideration of scheduling a Work Session of
City Council with the Coppell Historic District Committee, and
others, to review the plans, goals and objectives of that
Committee, tentatively scheduled for Monday, February 19,
1990.
16E. Approval of Change Order #2 for the Village Parkway Reservoir
project deleting $19,000.00 of site grassing and sodding
requirements. Approval of Change Order #6 for the Village
Parkway Pump Station project deleting $1,267.00 of site
grassing requirements.
]6F. Consideration, discussion, and award of a contract for
installation of the Base Bid (w/o rye grass) and Alternates
#lA and #lB of the Village Parkway Pump Station Landscaping
Project to Landscape Design & Construction, Inc. in the amount
of $39,683.00 and authorizing the Mayor to sign.
16G. Discussion and consideration of approving a payment in the
amount of $45,430.84 to D.T. Construction, Inc., for the
improvements of Samuel Boulevard, a portion fronting St. Ann
Catholic Church.
16H. Consideration of awarding a contract for Parkway Boulevard
improvement from Alex Drive to Heartz Road in the amount of

16N. Discussion and consideration of waiving the permit fees,
procedures, and size limitation for signs to be used in the
upcoming Bond Election.
Mayor Wolfe reminded the Council that Items 16A and 16B had been
deleted.
Councilman Morton moved that the remaining Consent Agenda be approved as
submitted and the Mayor be authorized to sign the necessary documents.
