Box 478 Coppell, TX 75019 Re: Easement Acquisition for Grapevine Creek Sewer Project This letter is written to verify the negotiations arrived at during our meeting of April 5, 1993 between you, Mr. Wayne Ginn and myself. At that meeting, it was agreed upon that I would grant the easement across the property jointly owned by Troth Enterprises, Inc, S.C. Parsons, Inc. and Lerman Investments, Inc. for a total price of $15,000. This generally works out to approximately $0.37/sq. ft. for the permanent easement (35,639 square feet x. 37 = 13,186.43) and a nominal amount of $1,813.57 for the temporary construction easement (66,471 square feet). It is my understanding that this offer will be taken to the City Council meeting of April 13, 1993 for approval by the City Council. If the City Council approves the offer of $15,000 that we discussed, it is also my understanding that a check could be provided from the City on either April 16th or April 23rd, 1993. By virtue of this letter please be advised that if the City Council rejects the offer that we have negotiated of $15,000, then I will still grant the City the Right of Entry to the property for the construction of the Grapevine Creek Sewer Trunk Main. The Right of Entry is being granted because, as we discussed, I am in agreement with the project and if the amount is rejected by the City Council then we would work toward another negotiated amount or proceed through condemnation hearings. However, it is not my intent to hold up the project during any additional negotiations. After City Council approves this agreement, I will sign the necessary easement documents to be filed with the county. It is my understanding, per a legal opinion that you have received from Mr. Ron Clark of Henderson, Bryant and Wolfe LLP, that I will receive credit for fees previously paid for Northlake Woodlands East Phase 10B that was never final platted. It is my understanding that the previously paid funds are in the amount of approximately $125,000 - $130,000. It is my understanding that when I final plat Northlake Woodlands East Phase 10B I will be responsible for the payment of the current City of Coppell fees.
