Heartz Road, Dobecka Drive, Ctear Creek Lane Gear Keith, As you Know, bids were opened on July 8, 2010 for the above referenced project, and bid tabulations have been prepared documenting the seven bids. After careful examination of the bid documents, there were no errors that affected the results of the bids as they were read. One discrepancy was noted in one of the higher bids as indicated in the attached bid tabulations. The 2009 Tax Streets project was bid in such a way that the City has the option to award multiple contractors based on the low bid on each street or a lower total overall bid. The low bidders on each of the streets and the overall project are as follows. - S. Heartz Read — RKM Utility Services, Inc. ($ 534,582.50) - Dobecka Drive — Conatser Construction, TIC L.P. ($ 297,835.00 - Clear Creek Lane — RKM Utility Services, Inc. ($ 587,597.50) - Total bid for all three streets— RKM Utility Services, Inc. ($ 1 ,423,792.50) TNP has contacted both RKM Utility Services, Inc. and Conatser Construction, TX L.P. and received information regarding each company's past and present experience, as well as the type of equipment available. We have also contacted representatives from each of the companies to further discuss the scope of the project and the potential award of contract. RKM Utility Services, Inc. provided a list of public sector projects in many cities in the area. All of the references that were contacted responded positively_ One reference stated that RKM had previously been awarded two additional contracts in the City, and they would continue to work with this company. i have further discussed the scope of the project with Mr. Dennis Gulley at RKM, and I believe that he provided a bid in good faith and understanding of the project. 12160 North Abrarns Roan, Suite 508 Dallas, Texas 75243 214.161.9867 phone 214.461.9864 fax www. tnp-onitne. com Conatser Construction provided with their reference information a letter further detailing their project breakdown and company size. It appears that they work in both the public and private sector with a majority of the work being on the public side. Conatser is well known in the private sector as being a contractor that performs the project well and quickly completes the job. I have further discussed the scope of the project with Russ Sigman at Conatser, and I believe that he provided a bid in good faith and understanding of the project. It is my understanding that the City would prefer to award the project on a "per street bid" basis and not as an overall contract to one contractor. The results of the bids received allow for the project to be divided among two contractors and remain awarded to the low bidder for each street. Based on the information provided by the low bidders and obtained during TNP's research, it appears that the following construction contracts should be awarded. Not included in the below contract amounts is the potential incentive award of up to $40,000 per street for a total of up to $ 120,000. - S. Heartz Road — RKM Utility Services, Inc. ($ 534,582.50) - Dobecka Drive — Conatser Construction, TX L.P. ($ 297,835.00) - Clear Creek Lane — RKM Utility Services, Inc. ($ 587,597.50) Not included in the above contract amounts is the potential incentive award of up to $40,000 per street for a total of up to $ 120,000 for the total project. This incentive amount would be for early completion of the project based on the projected number of days needed for the completion of each street as stated in the bid documents.
