Today at approximately 3:40 p.m., I received a phone call from Roy
Brock. Roy was inquiring as to the status of the easement
acquisition and follow up to our meeting with him several weeks
ago. I advised Roy since we had not received a proposal from him
as requested at our meeting, it was our feeling that an agreeable
compensation for both parties was not possible, and condemnation
was necessary.
I informed Roy that staff looked into the variance covering front
yard set back requirements on these lots and it was concluded a
variance could only be considered by the Zoning Board of
Adjustments.
After discussing this matter with Mr. Street, Roy said it was their
belief a fair and reasonable compensation for both lots is
$57,193.00 (see below).
Lot 8, Block F Lot 9, Block F
Compensation = $28,318.00 Compensation = $28,875.00
Additionally, Roy indicated that this compensation accompanies the
stipulation that they be given favorable consideration regarding
front yard set back variances. I informed Mr. Brock that I would
be submitting this information to your office.
