Dear Mr. Middleton:
On January 3, 1991 I received your letter dated December 21, 1990, along with
the itemized list of the Estimated Probable Cost of the above referenced
project. This appears to complete the scope of services outlined in the
City's August 10, 1989 contract with Kimley-Horn & Associates, Inc.
I also received an invoice, #086186, submitted from you for additional
services in the amount of $7,563.].9. in Staff's file search, we were unable
to locate any related proposal amending the August 10, 1989 contract. Please
note that to my knowledge, we did not authorize any additional services and
had advised you accordingly. As you know, the only funds available for this
project was the DART's LAP funds, and as per our contract, the related
services were to be provided by Kimley-Horn for a lump sum fee of $20,000.00.
I respectfully return the referenced invoice #086186 without pay and per our
telephone conversation today, I assume we are in agreement. I would like to
indicate that we have enjoyed working with you, and we are pleased with the
result of this project.
Please return all related documents and engineering plans that you checked out
from Public Works files for completion of this project to Ben dela Cruz of our
office. If you have any questions, please don't hesitate to call me.
