SIDEWALK EASEMENT

§ KNOW ALL MEN BY THESE PRESENTS
COUNTY OF DALLAS §
THAT the term Grantor used herein shall be construed in the singular or plural
number as such term respectively represents one or more than one person.
THAT, WILLIAM C. STEARMAN III, known herein as GRANTOR, in consideration of
the sum of Ten and No/ 100 Dollars ($10.00) and other good and valuable consideration in hand
paid by the City of Coppell, Texas, ( "GRANTEE "), receipt of which is hereby acknowledged,
does by these present grant, bargain and convey unto GRANTEE, the free and uninterrupted use,
liberty and privilege of passage in, along, upon and across the following described property owned
by GRANTOR (the "Sidewalk Easement ") for the purpose of constructing a public or pedestrian
right -of -way sidewalk across GRANTOR'S main tract with the right and privilege at all times, of
the GRANTEE herein, its agents, employees, workmen and representatives having ingress,
egress, and regress in, along, upon and across said premises (the "Sidewalk Easement ") for the
purpose of making additions to, improvements on and repairs to said sidewalk or any part thereof.
Said Sidewalk Easement being described in Exhibits "A" and "B" attached hereto and
made a part hereof for all purposes.
That in consideration of the benefits above set out, GRANTEE will remove from the
Sidewalk Easement, such fences, buildings and other obstructions as may be found upon said
property. After construction of the sidewalk has been completed, GRANTEE shall, except for
removed obstructions, return the surface area of the Sidewalk Easement to its original condition as
nearly as practical taking into consideration the nature of the work being performed. GRANTOR
reserve the right to use and maintain the surface of the Sidewalk Easement for purposes which will
not interfere with GRANTEE'S rights hereby granted and agree that upon completion of the
sidewalk improvements and restoration of the surface, GRANTEE shall not be obligated for future
maintenance and upkeep of the surface area.
TO HAVE AND TO HOLD unto the City of Coppell, Texas, its successors or assigns
for the purposes aforesaid, the premises above described.

LEGAL DESCRIPTION
PERMANENT SIDEWALK EASEMENT.
BEING 0.0153 acre of land located in the EDWARD A. CROW SURVEY,
ABSTRACT No 301, City of Coppell, Dallas County, Texas, being a portion of
the tract of land conveyed to WILLIAM C. STEARMAN III. by the deed recorded
in Volume 2001003, Page 3258, of the Deed Records of Dallas County, Texas.
Said 0.0153 acre of land being more particularly described by metes and bounds
as follows.
BEGINNING at a '/4" iron pipe found at the Southwest corner of said Stearman
tract, and the Northwest corner of the tract of land conveyed to FIRST
BAPTIST CHURCH OF COPPELL, by the deed recorded in County
Clerk's file number 200900002898, and said POINT OF BEGINNING lying
in the East right -of -way line of Denton Tap Road (a 100' right -of -way at
this point):
THENCE N 01` 35'46" W 66.69 feet, along the West boundary line of
said Stearman tract, and the East right -of -way line of said Denton Tap
Road, to a point at the Northwest corner of aforesaid Stearman tract,
same point being the Southwest corner of the tract of land conveyed to
MK Wolfe Enterprises, INC., according to the deed recorded in Volume
96172, Page 5579, of the Deed Records of Dallas County, Texas;
THENCE N 89° 44' 11" E 10.00 feet, along the North boundary line of
said Stearman tract , and the south boundary line of said Wolfe tract, to a
point,
THENCE S 01" 35'46" E 66.71 feet, to a point in the South boundary
line of said Stearman tract,
THENCE S 89' 51' 39" E 10 00 feet, along the South boundary line of
said Stearman tract, to the POINT OF BEGINNING. containing 0.0153
