According to our Superintendent at the time, Steve Kennemer, we called in locates for the existing water line and after it was marked it matched the plan location. We removed the concrete to install the new line and make the tie in per plans. After removing the concrete we found the existing water line was not where it showed on plans or where it had been marked during locates. The existing was actually in conflict with the proposed location of the new line. We had to move the proposed line to the east in order to avoid the existing line and to make the tie in. This necessitated the removal of additional concrete to avoid several days' disruption in water service if we had left the proposed line per plan location. We were given the green light to remove additional pavement to avoid the actual location of the existing line. Because of this and the existing line being marked incorrectly we are requesting additional payment for the concrete. My previous email detailed quantities. And yes during the bidding process approximate quantities were not shown but we did a quantity take off based on plans in order to come up with a lump sum price. What I was showing you were our take off quantities vs. in place measured quantities. For the sidewalk I looked at our measurement sheet for the project. There are four locations for sidewalk replacement. Three of them are for 6' wide sidewalk and one for 4' wide sidewalk. I am assuming that the 4' sidewalk was at the intersection of Dillard and Anderson. There might have been a panel replacement due to the tie in point. I don't know for sure unless I visit the site. Our request for an additional $1350 for pavement replacement is based off the difference of our estimated take off and what was actually installed. We are only asking for additional compensation because the location of existing water line was misrepresented on plans and marked incorrectly by locators. We do not feel that this was our mistake during the bidding process or during construction and should not be penalized for something that was out of our control. As I said last week, we agree that the removal of the headwall structure was not indicated in the plans. While we feel the cost proposed by Bowman Construction is on the high side, we agree to this request. As far as the concrete goes, I'll address the street and walk separately. The plans indicate that the crossing of Dillard is to be by open cut, or other than open cut at the discretion of the contractor. The specifications indicate that pavement repair or bore shall be done in accordance with appropriate city details. I see nothing in the documents that indicates a quantity of 27 SY of pavement to be removed and replaced. As this was a lump sum bid, it is our position that the decision to open cut the street rather than bore it should have included the full cost of the concrete replacement. At no time during the removal did the city ask you to remove and replace any additional concrete other than what was required to comply with our standards. We measured the sidewalk today. There are only 3 locations that appear to us to have been removed, and replaced for a total quantity of approximately 100 SF. Again, this was bid as a lump sum job, with no identified quantity in the bid documents, and a t no time did the city ask you to remove and replace anything more than what was required to complete the project. I am happy to meet with you or Mr. Bowman at the project location to discuss this further if you wish. If you would prefer to close this project out, please revise your pay request to eliminate the additional concrete, and submit a signed original with an affidavit of final payment. The original bid contained three locations for sidewalk replacement for an estimated quantity of 90 SF (three panels that are 5'x6'). We actually replaced four places that totaled 156.2 SF (5.5'x6', 8.2'x6', 7.8'x6', and 6.8'x4'). On pavement the bid contained an estimated quantity of 27 SY (40'x6'). This was to replace the concrete at the intersection of Dillard and Anderson with a trench opening of 40'x6'. Based on joint patterns and condition of existing concrete we ended up replacing additional concrete. The trench part of the replaced ended up being 36'x6' but we had and additional replacement of 16'x3.5' on Anderson. Those two measurements were for 8" pavement to match the existing thickness of Anderson. Then we match existing thickness on Dillard which is 6". We replaced a strip that was 36'x2.5' and both radii along with 12' of curb. Total pavement replacement came to 46 SY which is 19 SY more than the original estimated quantity. The sidewalk came out to an additional 66 SF from original estimate. This is why we are asking for additional compensation to cover the cost of the additional materials labor and equipment used to replaced the pavement that we were asked to complete.
