Box 9478 Coppell, TX 75019 Dear Suzan, This letter is a more formalized proposal of what we discussed in your office last Wednesday, June 1, 2005 concerning the upcoming road improvement project on W. Bethel Rd. and related drainage easement of creek effecting parcels of land needed for project: a) to set value on land owned by Chadick Capital L.P. needed for "Right -of -Way" improvements to Bethel Rd as well as b) an exchange of a portion of this very land owned by Chadick Capital for the remainder of a City owned tract effected by the very same project after a drainage easement has been carved out for said project. 1. Set any "Right -of -Way" values on land needed for City improvement project proposed on Bethel Rd. based on current D.I.A.D 2005 property valuations. 2. Trade in totality the drainage easement, right -of -way, and remainder of Chadick Capital L.P.'s property located at 595 S. Coppell Rd. (tract described as John Vest Survey, A -1508: Vol. 99114, Pg. 08140) totaling approximately 25,580 sq. ft. for remaining portion of City property east of a proposed drainage easement on City land -- moreover described as James A. Simmons Survey, A -1296: Vol. 2003094, Pg. 00797, this remainder comprising a total of roughly 16,500 sq. ft. In addition, we would request the City remove all brush and dead trees from this tract as well as place no additional restrictions on development of this land in the future. Is an LOMR needed? 3. We would like to suggest that whatever way the drainage easement needed from Chadick Capital land located at 516 W. Bethel Rd. (shown on the Joseph H. Peaster survey dated 6 -09 -04 moreover described as part of the John Vest Survey, A -1508: Vol. 99114, Pg. 08104) is secured - either through prescriptive purchase or outright purchase - -that said purchase be considered in the best interest of remaining parcel's future development potential and worth.
