Freese and Nichols 1701 North Market Street, Suite 500 LB 51 Dallas, TX 75202 RE: Bethel Road II Project # ST 03 -01 Dear Ms. Hatley: Thank you for your rapid response on providing me the breakout of the permanent right -of -way verses the prescriptive right -of -way for the northwest corner of Coppell/Bethel Road. Upon further review of the 'very simple' 8 -page legal document prepared by our attorney, for the exchange of property between the City of Coppell and Steven Chadick, I noted that I will need a legal description that describes just the amount of property which we will be exchanging with Mr. Chadick. A portion of the northwest corner of Coppell/Bethel Road will be combined with another tract of land, which Mr. Chadick owns, to arrive at a total exchange of 16,537 square feet. The second parcel, which Mr. Chadick owns, is 11,917 square feet. So, I need a metes and bounds description and exhibit of a part of the permanent right -of -way that equals 4,620 square feet. I have marked up the prior documents provided to the City of Coppell to show the breakout of the 4,620 square feet and the remainder of the property, which would be 522 square feet. I need a metes and bounds description and exhibit for both parcels. If possible, I need the parcels broken out in the same manner as shown on the 'marked up' exhibit provided with this letter (yellow would be the 4,620 square feet and pink would be the 522 square feet). Using just rough numbers, I attempted to modify Mr. Britain's legal description of the permanent right -of -way to generally reflect the parcel that is shown in yellow. Mr. Britain can do a far better job of writing his own legal description than 1 can. 1 only made changes to clearly show that I need the 4,620 square feet to come off in a certain area of the total land. The City is trying to consummate the exchange of property with Mr. Chadick shortly after the first of the year. Therefore, any assistance in expediting the splitting of the original permanent right -of -way into two separate metes and bounds descriptions and exhibits would be appreciated. If the preparation of the metes and bounds descriptions and exhibits falls outside the scope of your contract please provide an invoice when the documents are provided to me.
