Dear Mr. Robinson:
This letter is written as a follow -up to our meeting of November 10, 1994 in which we discussed
the development process for the referenced location. In performing some of my background
research on the basic question of whether or not this is an expansion of an existing nonconforming
use, I noticed that it didn't appear as though Kamwell, Inc. owns the majority of the property on
which the development is proposed. In particular, the abstract maps show a large part of the
development will be located on what is noted as Tracts 7.1, 4.1, 4.27 and 11. Our current tax
records show that Tract 7.1 is approximately 5.14 acres, Tract 4.1 is approximately 34.75 acres and
Tract 11 is approximately 5.96 acres and all three are owned by Fraser Gordon Properties, LTD. of
Canada. The tax records also show that Tract 4.27 is approximately 9.64 acres and is owned by
Triland Northstead J.V. in Dallas.
If Kamwell, Inc. is now the owner of Tract 4.1, 4.27, 11 and/or 7.1, please provide documentation
to this office showing when those purchases were made by Kamwell, Inc. Once that information
has been received, I can finalize my discussions with our City Attorney on the status of the
development of this property in regards to an expansion of a nonconforming use.
