_Ledbetter Rd-CS 950717 July 17, 1995 John Robinson Lone Star Country Club 1849 East Belt Line Road Coppell, TX 75019 Re: Ledbetter Road Abandonment Dear John: This letter is a follow up to Council action of June 13, 1995 and our subsequent phone conversation concerning the abandonment of Ledbetter Road. The Council approved the ordinance abandoning Ledbetter Road with the stipulation that the legal description of the road to be abandoned be attached as an exhibit and that the abutting property owners provide written consent. I am providing a copy of the ordinance as it was approved by City Council. As of this date, the City has received a letter from Cardinal Communications dated May 4, 1995 in which they state they have no problem with your expansion project provided the road is maintained and kept clear for vehicles. The City has not received any correspondence from Explorer Pipeline which owns the southwest corner of the intersection of Ledbetter Road with Beltline Road. While the May 4th letter does not specifically provide consent to the abandonment, it does mention maintaining the roadway etc., so there appears to be some implied knowledge that the roadway was to be abandoned. To resolve this issue such that there is no confusion in the future, the cleanest way would be for all the affected parties to provide written consent or to record a mutual access easement among KKR, Kamwell Inc., Explorer Pipeline, and Cardinal Communications. Along with the ordinance approved by Council, I am providing you a copy of the exhibit showing what will be abandoned. One thing to note is that the City abandoned 20 foot either side of the center line of Ledbetter Road. That did not include the Texas Utilities power line. As can be seen on Exhibit "B", their power poles are located outside of the shaded area described by the ordinance to be abandoned. Any issues with TU Electric should be addressed directly with TU Electric. The City has only abandoned its legal interest, if any, in Ledbetter Road. If you have any questions concerning this please feel free to contact me. Once we receive written consent or the mutual access easement, the ordinance can be published in the paper and released for recordation abandoning the City's rights in Ledbetter Road.
