Re: Traffic Study at the intersection of Ledbetter and Beltline Road

Dear Mr. Smith:
At the April 13, 1993 City Council meeting, Johnny Thompson came forth with a concern about
the aforementioned intersection. His concern was that the speed of the vehicles was too great
coming over the bridge over the Elm Fork of the Trinity River from Carrollton and the fact that
there may need to be a traffic light installed. The Engineering Department has undertaken the
initial steps to gather the raw data to perform a traffic study at the intersection. This study will
determine whether or not the speed limit is correctly set and if a traffic light is warranted. While
Mr. Thompson was presenting this concern at the City Council meeting, I remembered that when
he obtained his zoning that there was some stipulations about the installation of a traffic light.
Attached to this memo is a copy of the minutes of the February 11, 1992 City Council meeting in
which Zoning Case #S -1057 Longbranch Country Club from A, agricultural to LI.SUP, light
industrial special use permit was considered. You will note that the zoning change was approved
with the following conditions....5. Applicant will provide a traffic light when warranted at the
applicants expense, said traffic light will be provided as determined by City staff, at the applicants
expense: ... Based on the conditions placed on the zoning change, it appears as thought if a traffic
light is warranted it should be paid for and installed at the applicants expense i.e., and/or the current
owner of the property.
Since you have been the lead attorney for the City of Coppell, I recall several times that you have
cautioned staff and/or City Council about placing conditions on zoning changes. My question to
you is are the conditions placed on the zoning change for the Longbranch Country Club on
February 11, 1992, valid conditions and if so if a traffic light is warranted should the City pursue
the expense of the installation of the traffic light from Mr. Thompson. I am unsure if Mr. Angelo
Vacaro, speaking on behalf of Johnny Thompson, volunteered these conditions or if they were
arbitrarily placed on the zoning change by the City Council. If you wish I will pursue getting an
actual transcript of this public hearing.
Please respond if you need any additional information, if not I will await your determination before
pursuing this matter.
