Re: Dedication by RTC of Easements along Hertz Road ~D
Dear Shohre:
I have just received from counsel to the RTC in Denver a group of easement
documents which have been dedicated to the City. After review, they appear to be identical
to the easements dedicated by Parks of Coppell and upon which we insisted upon a few
changes. However, from a legal standpoint, I do not see any fundamental flaws or major
problems with the documents and unless you wish otherwise, I suggest the City record these
easements.
You will notice that at the back of each one, the RTC has enclosed an Acceptance
Certificate. As you know, there is no legal requirement that the City execute such a
certificate unless it wants to. It can directly record the easement.
I am hereby enclosing these easements for your review and disposal. If you have any
further questions or want to discuss further, please don't hesitate to call.
