Re: Heartz Road Project - Final Acceptance Conditions
Dear Larry:
As you know, we previously applied grass to the required areas along Heartz Road as set forth in
my letter to you of October 8, 1991. The extremely large amount of rain that we had a few days
after the grass was placed washed most of the seed away. Also, the weather has turned much
colder in the intervening time. I am writing this to confirm that I am aware that your final
acceptance of the Heartz Road project is subject to grass being applied again to the required
areas. Because of the time of year and the temperature, we need your approval to use a rye
grass seed so we will have an adequate erosion control through the winter. The rye grass seed
will be placed within 14 working days after final acceptance of the Heartz Road project. We
agree to reseed the area with Bermuda grass next spring at an appropriate time. The other
items set forth in the October 8 letter have already been accomplished. If you have any
questions, please let me know, or otherwise I will assume that this is acceptable.
