I am writing this letter for the purpose of answering several questions I understand that~o.u
have raised with respect t0 the ~mpletion and a~eptance of Hea~ Road which were not ~vered

Responsibility for Sidewalks Across Box Culvert - As with all of the area along Heartz
which is not in the Park Place Addition, the responsibility for ~nstruction of sidewalks will be
imposed on the developers of those properties at the time their property is platted or at the
time that building permits are issued on their developed sites. The actual frontage where the
box culvert is located on the west side of Hea~ Road is owned by the Parks of Coppell Trust.
The frontage on the east side of Heartz Road is owned by ABQ Federal Savings Bank. As those
areas are platted, the sidewalk requirement should be addressed at that time.
Siltation of East Pond - As I am sure you are aware, the City approved in conjunction with
the platting ~_ P~r~ ~Place a~~6[d~[~[-60th ~6]~a{S~0oidb-~ [!!0Wed t6 use the Privaie
recorded drainage easement, which is an agreement between ABQ and the P~rks 0f Coppell J6int
Venture and their successors and assigns (the "Mutual Drainage Easement"), as a point of
discharge for the drainage facilities constructed with Hea~z Road and Park Place. The pond east
of Heartz Road in question is pall of the area included in the Mutual Drainage Easement. The
City authorized use of the Mutual Drainage Easement in its existing condition in Mr. Ratliff's
letter to me of October 5, 1990, as further clarified in Mr. Ratliff's letter of October 8, 1990.
The maintenance of the Mutual Drainage Easement in such a manner that it continues to function
is the direct responsibility of the owner of the property through which any portion of the
channel may be located, being either Parks of Coppell Trust or ABQ. However, as developer of
Park Place, Allen Prope~y Corporation will agree on a limited basis to remove any necessary
siltation or blockage in the east pond which is causing the disfunction of the storm drainage
system in Park Place as needed, on the following ~nditions:

1. The maintenance responsibility period shall be limited to one year from the date of
final acceptance of the Park Place Addition or until July 8, 1992 (the "Maintenance Period").
At the current rate of construction of homes occurring in the Park Place Addition, the
subdivision would have homes commenced on all of the lots in approximately nine months. As
landscaping is established, the contribution to the siltation problem from the Park Place
Addition should cease.
2. If other property commences development in the drainage area which flows into the
east pond during the Maintenance Period, the City will agree to require of that developer a
similar responsibility for correcting such siltation problems.
3. Should there be a disagreement over the extent to which a problem should be
corrected during the Maintenance Period, we will agree to abide by the decision of Dan Dowdey &
Associates, Civil Engineers as to the required degree of maintenance.
Remaining Heartz Road Fees - Enclosed is a copy of a Public Works memorandum dated
October 4, 1992 setting forth the construction fees for the Heartz Road extension. Those fees
remaining unpaid at this time are the street light assessment and street sign assessment, being
a total of $4,417.18. We have enclosed our check for these fees with Larry Davis' copy of this
letter. I assume Larry will ask the accounting departmen~'t(~'-retU-7-h-~'rbceipt to us.
